Has anyone recently requested a FPEB? I requested one on 10FEB26.

My PEBLO and assigned legal said they are going pretty quick compared to the last couple years and that I will be receiving my hearing date letter within 2 weeks and most likely my date will be within 2 weeks of when I receive my letter.

Trying to gauge Navy timelines.

That timeline seems about right. When I requested my first one on 4 Aug, they gave me a 28 Aug FPEB date. I ended up having surgery and then the gov shutdown happened, so I actually had my board on 4 Dec. Let me know if you have any questions. Has your counsel told you about stipulations and if they expect the PEB to come back with a stipulation?
 
A stipulation is essentially a settlement. In my case, the DoD rating came back as 10%, and the VA came back as 90%. My counsel made the argument in my FPEB appeal that some of the additional conditions that I have are unfitting as a residual from the original condition. About 1 hour before the formal board (mine was virtual), the PEB offered a stipulation to add those additional unfitting conditions and bumped my DoD percentage to 30%, which is what I wanted, being at 16 years and unable to retire at 20 like I wanted originally.
 
Oh ok. I don’t have my formal hearing date yet but hopefully that can happen for me too. They came back with 30/100 P&T but found one of my referred conditions as fit where as the VA gave me 50% and the DoD said my Migraines can be controlled by medication which in my record it says the medication makes me drowsy and I cannot function if I have to take the medication. My migraines are a direct result from a TBI I got from a rocket explosion while deployed so I am fighting to get it as unfit for CRSC reasons and potentially having the Richard Star Act passed eventually lol
 
Understood. Sorry that happened to you. I hope the Richard Star act is passed, even if it won't get me any benefit, as my unfitness didn't come from combat, it was from a carcinoid lung tumor where I had a biopsy that turned into a life saving surgery, and has caused permanent pain and vocal cord paralysis. Suffice to say I'll be having some supplemental claims after I'm retired.

Well damn that sounds horrible! I’m sorry for just happened to you. If you ever deployed or did any deployment workups you can try and link that to Combat Related. There’s a few different categories as to what constitutes Combat Related. Mine happens to be direct combat but there’s other things too dosent have to be direct combat.

Yeah, I did 2 deployments to Persian Gulf and the condition is covered under the PACT act, I'll have to do some research on the CRSC front.

I got my letter yesterday for my hearing date on 5 March! Took only 1 week and if only counting business days 3.
 
That's great! I suggest getting with your assigned FPEB counsel as soon as possible and formulating a game plan. Have a good idea of what you're looking to get out of the FPEB and any goals you have. Also, if you haven't looked into it yet, as a member of the IDES you are eligible for VR&E through the VA. Just something to look into.
 
Hey, update when you get your findings! Hoping for good things for you. I actually received my IPEB findings today - it took barely a month from when I submitted it to the IPEB. I got TDRL and non-combat related, which were two things my IDES lawyer said I should fight if it came down to it, so now I get to go into the weekend considering if I want to hit the FPEB. Looks like it didn't add much time on to you but I hope you got better results.
 
My hearing went fine. They offered me a condition to be added to my unfitting conditions which would increase my DoD from 30 to 70 percent but they didn’t mark it as combat related so I said no deal and went through tho the whole hearing and now I wait for the results my FPEB attorney said about 2 weeks I should get notification.
 
Let us know how it goes/went! I just let my PEBLO know today that I'm asking for the same, for combat-related too. Would love to hear anything you want to share about the process or about how your board actually went. Hoping for only good results for ya.
 
I've never heard of "stipulations" that allow the service to give a lower rating than the VA. Upon information and belief, since the 2011 NDAA, the services are required to rate and pay the unfitting conditions at the same rating as the VA. "Stipulations" sounds like a cheat path for the services to pay less. What is the regulation or legal reference for "stipulations"?
