Just got granted 100% schedular with TDIU and P&T referred to MEB. Will they request new exams?

So I will keep this as brief as possible I just got 100% SchedularTDIU P&T my case manager told me she will need to pull some additional documents then she will submit MEB packet.
In my packet, I opted for IDES will DOD use my recent exams or schedule new ones? I literally just got done with the VA fighting a proposed reduction and a supplemental claim for TDIU. I was previously at 80% and I submitted new claims while fighting a reduction. I was pushed to 100% schedular because of my new claims but since my TDIU was granted an earlier effective date now 100% Schedular TDIU P&T. As for my questions Since my exams have been recently in the past 3 months will they use those exams? Will being TDIU in the guard speed up the process or set a flag in their system? What are the odds of me being 30% dod? I posted my VA ratings below. Lastly, a small rant the VA tried reducing me because I had a crappy C&P examiner who lied about my ROM and put mild sciatica even though I use a mobility scooter prescribed by VA for it! I have one last red tape to get over I can barely handle it I grew so many white hairs and debt from this process.

You will have new exams. Just bring in your old DBQ's that were accurate and tell them nothing has changed and you had an exam 3 months go etc. You should be fine. Also, if P&T the VA isn't going to change anything and if they do you can fight it later on though its pretty rare to get a rating changed if you recently had one. Your DOD % is based on whatever is unfitting. So it all depends. If they kick you out for mental health for example and your rating is 70% VA then your DOD will be 70%. How many good years do you have in the guard? Do you have a LOD? Is this duty related IDES? If non duty related IDES I would cancel and not choose IDES since they will kick you out with no retirement regardless.
 
In my case it is duty-related I just got my LOD a couple of months prior and it was for my Back and nerves. My mental health knee and GERD claims were just added recently.
I'm mainly worried because VA ratings for nerve and spine conditions are entirely subjective. I had to fight with a lawyer and I had to advocate for myself to get a second C&P exam. All it takes is one bad C&P examiner since I'm under the 5-year rule. It has been a crushing experience dealing with the VA, VR&E, and MEB at the same time. When I get my backpay I'm donating to this forum for all the hard work and time you guys put into it. One last question does MEB have access to my current updated VA ratings? and will they automatically add mental health or other service-connected conditions they deem unfitting? Oh and no retirement pay for me I only have seven good years sadly.

Only your referred unfit conditions will translate to a DOD% but they will mirror what the VA rates that condition. It may be worth it to get Mental Health added but it depends on a lot of other things. A lot of Soldiers don't get their medical retirement pension because its completely offset by VA compensation. What is your pay rank (such as E4 or O3 Etc) Was any of your conditions combat related? How many good years do you have? How long have you been in? How many points do you have?
 
I'm an E4 not combat-related injury with seven good years and I have been in service for eight years. I just checked my points and it's a total of 1469 Pts for retired pay.
I really wanted to go through the MEB process because I wanted Tricare and because the government screwed me on my GI bill. Guardsmen need 36 months of qualifying active service to get paid at the 100% rate of the GI bill. I currently sit at 70% because they didn't count my Title 32 service for year 2018. They didn't because president trump didn't declare the border a national emergency until FEB 2019. It's actually really messed up because I worked alongside active-duty troops that year and they were accruing benefits but i wasn't even though we were doing the same thing but I digress.

Sorry to hear that. That's why my wife did the Reserves instead of the Guard. That and you aren't stuck in only one state. Anyway, if you have a LOD and are referred to IDES then all you need is 30%. Tricare is valuable so whatever the VA rates the unfitting conditions that is what your DOD% will be. That total needs to be 30% or more. However, even if no Tricare at 100% VA you would qualify for CHAMPVA which isn't all too bad. So you don't have as much to lose as most.
 
If you can you should see if you can do LDES just to avoid the VA headaches of potentially reducing you again.
