Med Retirement Pay Help.

Hello,

Can someone help me out? I am getting 5 different answers from 5 different people.

I recently retired 2 weeks ago (Med Board) from the National Guard, I did 21 years and 16 of those were Active as I was AGR/Deployment) I received 100% DOD and 100% VA (TDRL). All my claims are combat related. The ratings were proposed. Still waiting on the VA site to update with final ratings.

Here's where I am getting confused along with everyone I talk to. I know I'll get VA compensation. Will I be able to get anything for doing 21 years Guard? The med board attorney said I would get 75% of my base pay until I come off TDRL. Then someone told me I could only apply for CRSC in 3 months. Someone else told me I couldn't get CRSC. The last person I spoke with said I would get CRDP but not until I am 60 years old.

DFAS shows (under my retire account) I will be paid about $3500 on May 30. Is this the pay until VA starts?

You earned two retirements... Chapter 61 medical retirement and Reserve/Guard retirement.

Under Chapter 61 you will immediately receive all of your VA and any residual (left over) DoD pay. Most do not have residual pay unless you're a higher ranking officer. Until the VA pay starts, you will receive all of your DoD pay.

At age 60 or earlier with combat time, you will be eligible for your Guard retirement. You will then be eligible for your Guard pay and VA pay in full via CRDP. However, if your combined Chapter 61 DoD pay reduced by VA pay is higher, you will keep those instead.

You can apply for CRSC which can make up some of the lost DoD pay due to the VA waiver.

I am unaware of any 3 month wait. Maybe a more experienced person can chime in. I will say before applying for CRSC definitely read up on this site. There are several members here who are very helpful and have answered a lot of questions especially regarding CRSC. It should help you prepare you paperwork.

Just know that CRSC is there to claw back compensation lost due to VA offset. There are many caps. So the goal is to max out compensation which for most is the value of your Retirement. If you are getting 75% DOD its possible you have already maxed out compensation. You need to calculate the value of your Guard pension and add it to your VA compensation to get the max pay you can receive. Take your chapter 61 pay and subtract it from this amount. If there is leftover amount then you are missing out and CRSC can help.

Most say there is a wait but its not mandatory. They are talking about waiting for VA award as you need to have your VA award letter to submit a CRSC packet. There is not official wait period to apply for CRSC. If you have a finalized award letter like some Reservist and Guardsman do then you can apply for CRSC the day after you get out if active duty or the day after you are officially retired if Reservist or Guardsman not on orders.

I think I'll have to wait on getting paid in order to figure all that out. I'm still waiting on everything to finalize.

I don't have my award letter from the VA yet, I do have the CRSC form just about filled out except for those parts. Should hear something in the next few weeks hopefully.
