Hello! New to this forum, and new to the entire process of MEB/PEB.

I've been in the Army national guard for 18 years, 4 combat tours (3 Iraq / 1 Afghanistan) with 0% VA disability, E6, title 32 fed employee. Currently in the process of getting a P3 held over my head due to an undiagnosed condition that's had extensive work-up and STILL being worked (LOD related).

Mday - flight engineer
dual status technician position - SMM inspector

There's a lot of information on this forum, almost overwhelming really. Any good starter threads any of you would recommend? I'm really just trying to get better informed on what my options are if I'm deemed medically SEPARATED and not medically retire (from my understanding, I need to hit 20 and I'm hoping it'll drag out that long)... and the 60/40 side of things, etc.

Work on making sure you have LOD and no matter what try to stretch it out to hit 20 good years. Might even think about making a deal with leadership that you will drop your packet enter gray area retirement as soon as you have 20 year letter in hand. You may benefit from a medical retirement but you want to work on LOD and as a backup make sure to hit those 20 good years. Remember, even if you get LOD that doesn't guarantee you can medically retire. If your unfitting condition is less than 30% you will be put in gray area retirement. You can't get severance because accepting it would forfeit your guard retirement.

You may want to look into FERS disability retirement if they kick you out because if that causes you to not be able to stay in your MIL Tech position then you could qualify for the FERS disability retirement. Check out posts regarding that. Also, whether its on the Guard side or the Mil TECH side I would recommend hiring an experienced disability attorney as soon as you find out that they are putting you in IDES.
 
If you are found medically unfit, you get a 15 year letter. Which is similar to a 20 year letter but you cannot get both VA compensation and 15 year reserve pension even at 60 years old. Its not great but it is a fall back.
 
Thanks for the info. Sounds like the 15 NOE is going to suck ass if that's the case.

Hypothetically when I get the 15 NOE, will the process be quick getting booted from service? My job is kind of tied to the guard, but I'm told I also have some rights in delaying this process by disagreeing with the outcome and going through a formal MEB? January will be 19 years for me so I really am trying to stretch it out if I can (while still working on an official diagnosis which I'm so damn close on)

They force you into the retired Reserves. Not sure if the name is same for Guard but basically you get put into a retired awaiting pay status.

As I said earlier look up previous posts with people in your situation. I believe you would qualify for a FERS disability retirement if that happened. You will definitely want to hire an attorney if that's the case as there are attorneys that specialize in helping federal workers obtain their FERS disability retirement.

So the short answer is yes in any case that they find you unfit if your job is tied to being in the guard you won't be able to keep your federal job either.
