PEBLO/JAG not helping

Hi guys. So I'm sure I'm not the only one with lots of questions about this whole process, but I have nobody to reach out to for answers because neither my PEBLO no my JAG will call/email me back and we can't meet in person due to COVID. So I was referred for PTSD (it was military related I believe) I am looking to be released from my contract ASAP so I chose LDES. I understand that there will be some trouble down the road for that decision, but I can deal with that later. However I can't find a lot of information on LDES as IDES is more popular and widely used. My questions are 1) What is the timeline for LDES? 2) Since my DoD and VA benefits are split, how will payment work after I am separated? 3) What is the likelihood that I will get less than 30% with PTSD as my referring condition? 4) Last thing I heard about my case was that it was waiting on MEB2 signature, what is that?

LDES is the old way of doing things. Not sure on timeline, I just know it’s faster since the VA isn’t really involved. You’ll have to do a VA claim after you get out. Make sure you do it within the first year though. You’ll get back paid up to a year but not more than that. As far as the last 2 points of your question, I’m at a loss. Contact your OMBUDSMAN if your PEBLO and jag suck. What base are you at?

Yeah, I've looked up all sorts of stuff on dealing with the VA after I get out, but with my conditions and situation I just needed to get out as quickly as possible. But the back pay thing is good to know, I didn't realize they would backpay. I'm at NAS Lemoore in CA.

#3 would require knowing more about your MH history.

Yea I learned about that backpay stuff in the VA transition class. They don’t tell you that stuff when you start the DES referral

I have 2 contributing instances 1) is less likely to be listed as service related, but it is abuse for my ex husband due to the military life and 2) an assault from service members during a detachment. I have been in therapy on base for almost 2 years (continuing to go), was sent to an inpatient treatment facility for 28 days, and was given multiple medications.

If you are AD,everything that had onset while you are AD (except misconduct by you) if pretty much service connected. SC is more convoluted for NG/Reserve. MH conditions are rated by on their effect on your occupational and social functioning.

*Update* Answering my own questions incase someone else also has them
1) So far my LDES timeline has been:
Reccomended for MEB 12JUN21
Request LDES/ routing request to CO 15-20JUN21
NARSUM signed MEB 1 signature 20JUL21
MEB 2 signature 22JUL21
MEB acceptance signature 03AUG21
Package sent to PEB 04AUG21

2) Spoke to PS's and the way payment for LDES works is you can either choose to accept DoD payment while filing for VA when you get out, or forgo DoD payment and wait to file for VA benefits. If you take DoD payments then when you do get VA you will get docked pay for the amount the DoD has already paid slowly over time until that amount is paid back then you will get your normal amount. However if you chose to not take DoD payments and wait on VA benefits they will backpay you a lump sum of up to a year of when you filed your claim. There are 2 ways that you don't have to pay back the VA if you took the DoD payments, 1 is if it was combat related, and 2 is if you have done your 20 years in and can receive concurrent pay.

3) I have read multiple cases where the referring cause is PTSD and the findings have been 30% or even higher. However like everyone says this is case by case. I know it is almost guaranteed a higher percentage for VA, but as far as DoD goes it is more of a case by case scenario.

4) You need 2 signatures for the end of the MEB phase, not including the final approvers signature, MEB 2 is the second signature needed for the MEB phase package to be recommended for PEB.

The Code 16 attorney assigned to Lemoore also covers Bremerton as well as Oak Harbor and is stretched rather thin right now. They are reassigning the Lemoore duties to the attorneys at Camp Pendleton in the near future. If communications continue to be an issue, you can always reach out to the Code 16 program manager.
