Requesting FPEB to add unfitting conditions

Good morning ladies and gents,

My PEB case was accepted for action on 2Apr25, called my PEBLO and was found unfit on 21Apr25, and my VA claim closed on 24Apr25. I received my proposed VA benefits and they rated my referred condition at 20%. So now, I’m just waiting for my official findings and I assume I’ll get 20% DoD. When I received my NARSUM, my PEBLO told me that I can attempt to add more unfitting conditions to try and get medically retired. How hard is to get PTSD as another unfitting condition? I’ve been seeing a therapist for the past couple months. I’m also rated at 50% by the VA. Should I throw as many of my VA rated conditions at the FPEB and see what sticks? Any advice or guidance would be greatly appreciated
 
I’m awaiting my FPEB, my lawyer went over the conditions that would be added that have the best case to win. For my PTSD she had me get a letter from my therapist to state my current mental state, treatment plan and so on. Also being specific with diagnosis goes a long way.
 
Just remember that mental health can be a harder condition to get added. The military generally wants to see a pretty heavy timeline of treatment and medications to justify an unfitting condition. Mine was denied an MEB the first time due to this "lack of time" and was not added until I hit the MEB stage for my other conditions by a doctor outside of my MTF who was assisting with my MEB/NARSUM portion. Best of luck and like stated above submit everything you can showing treatments and therapies tried and possibly any medications you have taken to help.

Ive going every week for the past 2 months. However, I’ve never been medicated for it. My therapist diagnosed me with chronic PTSD w/ major depression. Is that enough of timeframe? I assume once my FPEB rolls around it’ll be 4ish months of weekly treatment.

I don’t know how it will be for you but on the army side they’re scheduling 7+ months out as of 2 weeks ago for the FPEB. Like I said above and especially because of the timeframe of what you have do NOT stress not having enough time. A diagnosis is a diagnosis, just keep supplying your PEBLO and your lawyer the documents they ask for and you will have everything you need. If they haven’t already told you, especially when you get closer to your FPEB get a letter from your therapist about your current state to submit. I’ll look for mine and send a pic tomorrow of what I’m talking about so you can see what I mean.

Remember its not just the diagnosis. The reason for finding unfit is that the condition prevents you from doing your job. Having a profile stating limitations for the condition is a must. If your symptoms don't prevent you from doing your job effectively then it won't be found unfit. Look at it from the military's point of view. They are seeing if you can do your job. If you can't they are trying to determine what conditions prevent you from doing so.

Its definitely your issue. Do they have your off post medical records? If you don't have profile why would they think it limits your ability to do your job? A medical profile is what tells your leadership what limitations that you have. Without it they can pretty much have you do work tasks with no limitations. So why would they find you unfit for mental health is no records showing limitations?

Start with getting a profile. Consider hiring a private attorney. That is what my wife did. He guided her through the process and told her exactly what documentation is needed for her to get. Then the attorney can write a brief before the FPEB outying your case. If its strong enough they sometimes agree and cancel the FPEB and make changes to your liking.

I DMd it to you. What Provis said about getting a good private attorney can’t be better said. 7 months is a super long time so I’ve just been scheduling appt after appt to eat up time at work.

Hi, I suggest you add the condition that you have exhausted all the treatment option on.
