Title 32 Technician Medical Retirement Scenarios (Please limit posts to "Technician Medical Retirements")

you should hire a good SSDI attorney. Don't even mess with doing any of this by yourself (they will always skrew you over) Once you have a legit attorney that knows what they are doing, you will get results. attorneys know how the medical documents need to be written for medical diagnosis and most doctors don't know how to write things the right way so SSA will always kick you things back. I would hire an attorney and resubmit.....thats just me!!!
Thanks for the info, but the criteria for SSDI, for my condition is outrageous.

Very true, I just got my denial letter from SSDI, and I have a heart condition, which the VA rated me at 60%.
Yeah your right. I was rated 100%just mental health 60%for other stuff VA and SSDI denied me. I didn't go to there exam either so that might have had an impact on it. I think it's best for me to work I'm not sure how it will work out but some form of work would be best.

My DR is all completed, they sent me my password for online. The back pay number seemed off other than that everything else is all good just took along time. Do we not pay social security or Fers every month out of the payment?hope it goes good for everyone. Finally over yes!!!

You will no longer receive SSDI benefits once you reach retirement age. However, your benefits will not stop completely. Instead, the SSA will simply convert your SSDI benefits amount to retirement benefits. You will still receive the same amount every month. This shift to retirement benefits will not happen until you have reached “full retirement age.” If you were born in 1960 or later, your full retirement age is 67 years old. If you were born before 1960, your full retirement age will vary based on your birth year.

Congrats, Jmc81 and thank you for keeping us updated.

Glad I found this thread. I’m in a similar boat right now but I’m hoping my packet goes through soon under the PL provision. Here is my timeline so far:

Feb 2022- Medically Retired ARNG 21 years
April 2022- Last day as Fed Tech
Aug 2022- Recieved letter stating my disability retirement was disallowed but I might qualify for retirement under PL (I knew this was coming from HRO brief).

My question is what else do I need to do? My HRO rep said there’s nothing more for me to do. The letter just says to get in touch with my personnel office. When I call opm they have no idea what I’m talking about.

Hello, you don’t have to do anything. Now you’re just playing the waiting game. In my case I got interim pay on my 5 month from the process and still getting interim pay. I’ll update as soon as my regular pay starts. But you will fall under the PL DR.

Thank you. 5 months from the original denial from opm or 5 months from when you sent the packet in?

Interim pay would be huge rn.

I got my denial on the 4 month of when I sent the packet, and on the next month I got interim pay, it back paid me like only 3 months so far, so they still owe me, but that comes after they approve the DR. But like Jmc81 brought up a while back, they are swamped with applications. But, keep checking up with OPM, they should be able to tell you your application is still being worked on.

Hello, in my case I didn't get my approval of DR or intriem pay. When I called OPM it never went anywhere. If you haven't received an approval a month or two after the OPM denial you should call the army benefits center they will be more helpful than OPM.

Wow. That/This is insanity. Financially I’m getting pretty desperate. Let’s hope this all works out for us all soon.

For anyone else interested I found this about the current opm retirement processing times. I don’t fully understand what it means other than yes they are very backlogged and it’s taking a while (a lot longer than I was initially told).

OPM processing status

By any chance have you applied for CRSC? If you’ve been to the Middle East, there’s a presumptive list of medical conditions that could help you get approved. It’s tax free money, and will get back paid if approved, but timelines on that are around 3 months. It use to be like 1.5 months, hope this helps. Thanks Jmc81 I forgot to mention ABCC

Thanks. Yes I did and was approved. Unfortunately I don’t understand how they do their calculations (came out to $91/month) but at this point anything will help.

Oh ok, yes their calculations are weird. Please keep this updated, it will help more people out on the process. As soon as I get my DR approved I’ll update, Thank you

30 Sep 22- Update, just got back pay from OPM and interim pay. Jmc81, I haven’t received the final decision letter in the mail, but will be waiting for it.

Awesome news Jesusej19 I was just thinking of this forum. Today I received a retirement packet had my information in it. I thought they didn't pay me enough back pay but after the packet I realized they took $5000 out for federal tax.

Thanks Jmc81, glad you got all your paperwork and back pay. I have one for you, on the packet, does it give you the amount of money you can make yearly so you don’t lose the DR pay? Also, does it give you an option to buy back military time ? Thank you
