Has anyone received an FPEB date in the last 7ish weeks?
It’s been 7 weeks since I contested my findings and most people I’ve talked to recently had a date within a month. I’m starting to get a little concerned as we are approaching almost two months since contesting.
 
Hello, I am USMC Reserves and I submitted my FPEB request May 17th.
Have you heard anything yet?

Someone let me know they submitted their request in April and received their FPEB date last week for the beginning of September.

Have you gotten a date yet? Last week I heard that someone who contested on May 23rd received a date for mid September.
 
After talking with my designated PEB attorney a week before the FPEB, they didn't think I could accomplish what I wanted or that the PEB would grant me what I wanted. So, I had the FPEB canceled and will instead submit a VARR, VA reconsideration to get a higher rating on one condition. Hopefully, you were able to get one scheduled for yourself!
 
Update:
I was appealing my IPEB to add mental health as a referred condition. Shortly after I requested the FPEB, I was diagnosed with psoriatic arthritis and was started on a biologic injection for treatment.
My FPEB attorney suggested that we request to add mental health and psoriasis with psoriatic arthritis as referred conditions.

I had my FPEB hearing scheduled for this morning. An hour before my hearing time I was called and offered a stipulation. Unfit for psoriatic arthritis, they still didn’t accept mental health. We accepted. My case will have to go back to the VA for a psoriatic arthritis rating. However, my lawyer said that my diagnosis, treatment and prognosis all indicate that I will make it to the 30% threshold for retirement. He predicts that I should have everything ready to submit to NAVPERS in about a month.
I am so thankful for have the end in sight, and ready to move past this.

I will say I’m slightly irritated about my mental health not being added. Without going into too much detail I am diagnosed with PTSD, depression, anxiety and social phobia. I am currently in an intensive outpatient therapy program and I have a 70% VA rating my mental health. However, this is still not enough for the PEB to accept. To me, it just shows how much work needs to be done for service members to receive and have access to better mental healthcare.

Here is my timeline thus far:

1 AUG 2023: Found medically unsuitable for sea duty orders to USS Abraham Lincoln due to ICD-10 codes: R06.02, R13.1, F32.9 (shortness of breath, dysphagia, major depressive disorder)

18 SEP 2023: official message stating “deployability assessment officer has reviewed MBR’s health information and MBR is directed to be referred to physical evaluation board (PEB) for disability evaluation per ref b for ICD-10 codes R13.1(dysphagia), K21.9 (GERD), R06.02 (shortness of breath), F32.9 (major depressive disorder), and I10 (hypertension).”

19 DEC 2023: IDES briefing

20 DEC 2023: Enrolled in IDES

21 DEC 2023: PEBLO makes contact, MEB officially started.

21 JAN 2024: VES reaches out stating they’ll be in touch to schedule C&P exams.

3 FEB 2024: First C&P exam

29 FEB 2024: Last C&P exam (would have been done 3 weeks earlier, but Dr. needed to reschedule)

19 MAR 2024: VES reaches out stating another C&P exam is required for sleep study.

26 MAR 2024: At home sleep study concluded and sent in.

5 APR 2024: NARSUM received, with 2 referring conditions, Eosinophilic Esophagitis and Dysphagia (VA diagnosis only)

9 APR 2024: First meeting with IDES counsel

11 APR 2024: Requested IMR to add unfitting condition.

16 APR 2024: IMR rejected

19 APR 2024: NARSUM signed

21 APR 2024: TOL shows “new IDES case, My Navy Assignment reflects “PEB accepted”

13 MAY 2024: PEB states “case is being voted on”

16 MAY 2024: VA 1000 number states I’m in the “decision phase”

Congratulations. You accepted the FPEB's offer. You could have chose to continue with the FPEB and might have had the mental health added too. Everything is a risk vs reward. Glad you will be medically retired. If the VA's rating is too low for psoriatic arthritis you can request a VARR to increase it. That's still on the table. However, since you are on biologic injections for it that should make it straightforward for rating purposes as long as the VA has all of your most recent medical information. You may want double check they have your most recent records since this diagnosis and medical visits were after they first pulled your health information.

That’s exactly why I accepted the stipulation. My attorney felt that there was still a chance, but I didn’t want to risk it. I’m thankful anything was offered to me at all, and even more so that it will likely lead to retirement. My attorney said the same thing regarding the rating being pretty straightforward. I can finally see the light at the end of the tunnel.

Glad to hear it's all coming to a close. When this process drags its feet you sure do feel it. I do wonder why the FPEB seems to always offer a solution prior to actual execution.

You'll have some annoyance with the findings in the way some things weren't acknowledged as you feel they should've been. My sole unfitting condition was my back, but I fought for fibromyalgia to be added. This is because my doctor in service refused to diagnose me himself & no rheumatologist within 200 miles wanted to run tests for it. I even requested to see a military doctor 200 miles away who rejected me on the basis of my doctor being capable of diagnosis. It pissed me off. The VA ended up diagnosing me and rating me at 40%.

The good news is results supersede feelings. You got 90% VA out the gate which is great. You may even get 100 based on this new rating you're expecting. Just be glad it's nearly over.
