Needing help figuring out what courses of action I can take?

I am an O3 in cadet command and in the middle of my C&P exams currently. My PMS has volunteered me for a S3 position at summer camp at FT Knox that while have me TDY there from 4 May to 24 August. I have informed him that I take medications that have to be refilled monthly and I receive monthly treatments for c-spine and lumbar spine injuries I received on jump a few years back, and not to mention that I go to a psychiatrist monthly for PTSD and anxiety treatments that require monthly refills for my medications.

I informed him that if I'm at camp for 4 months that I will have to change my PCM and go through the entire referral system to receive treatment while at camp and have to restart everything again when I get back if I'm still in the Army. I also told him that my PEBLO thinks that I could possibly be clearing in May and that it will interfere with my ability to get released while at camp since he will be out of country during camp on a CULP mission.

We had this conversation in late January and the only action he has taken was asking me to send a print out of my IDES dashboard to Brigade in order to project a replacement for me. I contacted our S1 at Brigade and asked what info I needed to send for justification for removal and he informed me that all they needed was a e-mail from my PMS, which he hasn't done yet. He has also denied my 4 day pass to go to a job conference in March to seek post military employment.

I'm starting to get a little pissed to say the least and I'm contemplating calling IG or EO but I'm not sure if being on a P3 and in a current MEB is justification to contact them or if I should wait until I receive a unfit for duty memo beforehand.

Any help or information about how to handle this FUBAR situation would be greatly appreciated.

I did an IG and my next eval was the lowest ever written by both raters. Surprise!! My career is over anyway so no big deal, but if there is a chance you'll be found fit I'd hold off. Once you think you have nothing left to lose, go for it.

Also, if I could do it again I would have went Congressional. If you're going to burn a bridge you might as well really pour on the gas.

P3 and in IDES should be sufficient reason to cancel a TDY. The PEBLO should have distributed a letter that makes it clear you will need to be available to the maximum extent possible. Probably a good reason to deny a 4 day too though. Its a restriction that cuts both ways, unfortunately.

I imagine S1 can work the issue too with the IDES dashboard printout. People just need a hardcopy. When someone is put in for a tasking, the LTC and CSM want to know why they were taken off. They want a piece of paper, not a story, to answer that question. They said email from PMS because sometimes people know an MEB is starting soon, but aren't yet in the system, so that answer will cover more scenarios.

I don't think IG would be much help really. I'd ask the PEBLO to run interference. At the end of the day, neither really has much authority to demand much. What both do is explain why the rules are that way and what risk the commander is putting on himself by doing something that could put him on blast. The general gets briefed about IDES timelines, and I imagine he won't want his name associated with that briefing in a negative way. I don't think it's needed though. I think most of the pissed is about the 4 day pass thing, which feels retaliatory. Not sure it is. You said you have to be available because of IDES. Then you ask if it is ok if you're unavailable. It becomes a hard thing to say yes to. Most leaves/passes are denied while in IDES, in my experience.

are all your C&P exams complete?
have you seen/signed your NARSUM yet?

the last has a definite time limit. I received mine on a thurs afternoon and it had to be signed by monday- found out later my PEBLO had it for 2 days before contacting me.

Are you serious, could your reply be anymore douchier? One its not a story I told him but facts of my current level of treatment and frequency, which is information he asked for. And by the way my PMS is a LTC and S1 said that any changes comes from our level and they just needed an email to confirm it. And to answer your another assumptions, yes my PEBLO did send him such letter, and no I'm not pissed about the 4 day pass because it's over spring break which we are off for anyways, it was more out of courtesy since its out of state.

But this is the second time you have answered one of my questions with a veil swipe at my motives or character without you knowing shit about me. and I admit I don't know anything about you, you could have been med boarded out because you got injured saving lives or you could have been some turd burglar claiming PTSD because you got scared hearing the incoming siren while standing in line at burger king on the FOB everyday while in country? So either just answer the question or go kick rocks and troll someone else.
 
IN your signature I see lots of CPs, have they found you unfit? My first go around in the IDES was on a similar timeline but in 2015. CPs in JAN 15, and then unfit memo in February 15 and I was supposed to be out in APR. I stopped all of the madness because I appealed at multiple levels but my ROTC unit didn't even think of sending me to summer camp in 2015. I likely would have embarrassed the hell out of them because when it's hot (ft Knox was blazing hot past summer) I literally have spells where I can't walk, at all for a while....

My thought is your unit is throwing you under the bus. Do they have other warm bodies they could use as summer camp cannon fodder? My guess is yes, they do. If there is someone not going to summer camp in your unit, then why aren't they going? I would go out of my way to get the most restrictive MH profile you possibly can. If found unfit and a good DOD/VA percentage, then do everything you can to get out as fast as you can. The Army is supposed to give you a certain amount of time to clear, ACAP, etc. if they don't, then blow the whistle to IG. My last OER sucked. It would have sucked no matter what, because I could no longer do my job. I stopped caring because I knew it would suck no matter what and I knew my time was up. Maybe ask for a call to the BDE commander? Nobody needs to be the damn S3 operations officer a month before they are put out of the Army. That is just shitty and nonsense.

The 4 day pass was a sat thru Tuesday, which everyone is off for anyways, I just put it in because the job conference is 5 hours out and two firms wanted me to come in to do a face to face. they received my resume prior to the conference.

My exams are done next week Monday and my peblo and va rep stated that they wouldn't receive them till the week prior to the conference based on the time line VA examiners have to compile notes and have them returned to her, and my peblo's advice on the subject was to just go and turn off my phone..lol Not a real solid plan

We have 4 NCOs and 2 other officers, 2 of the NCOs are retiring and one is pcsing in may. The part that I guess that is really pissing me off about the whole thing is our SMI got picked up for CSM academy this month and his date for the academy isn't till sep but the PMS already got him removed from camp and my PMS is taking a battalion command in NOV and is actively trying to get removed from the CULP mission, but he still has me Charlie Mike for 4 months to Knox even though I should be out this summer if I don't appeal.

As for the MH I did get diagnosed with PTSD and anxiety but it's not one of my unfit conditions I'm being boarded on, so not sure if I could get that done thru my civilian provider.

If you have to appeal, request a formal PEB, cadet command will be forced to send you TDY from summer camp to the FPEB. Shirk all of your duties and responsibilities and put your ides case first. The outcome of ides will effect your earnings for the rest of your life. In ten years nobody will ever remember if you were an amazing or mediocre summer camp S3.

I know that's easier said than done. I hope there is a happier less stressful ending where you don't have to go to camp.

Thanks Tony, I do have a quick question since you have already been through the process. Does the IPEB or MEB add conditions from your VA exam to your unfit conditions for DOD ratings or do they just stick to the initial unfit conditions if you don't appeal or request for them to be added?
 
You have a valid problem with the FT Knox TDY issue. My response was that I think the PEBLO would be a better source of help than IG. There are problems with both sources of help though. So I further clarified that I think this can be handled more easily by just giving S1 what you have rather than waiting on the PMS to write the letter. When you're in the right, sometimes it's just a matter of helping them out of their 3rd point of contact. These were direct attempts at advice.

You being in a MEB is a story. It is your story for the here and now it sounds like. Not all stories are lies. However, all stories lose their power the farther it gets from the source (the old kid's game of telephone example). So S1 doesn't want to tell your story, they want a simple piece of paper to hand someone. It is a great deal easier of an explanation. Sometimes if you understand why someone is asking for something, you can provide them an alternative. In fact, I bet if you could get a copy of the letter the PEBLO sent your CO, that would do. A solution now is better than waiting on someone to do their part.

I also believe the bigger problem is that your unit is giving you the quite typical, you're broken so we hate you now, treatment. The commander sounds like he understands you can't go to the TDY, but he just doesn't care enough about you to help you fix it. If the CO just sent S1 the PEBLO letter, he could fix this, I am betting. Instead he said you take care of it. This crap treatment is typical once you're in the MEB. I'm not positive what was a swipe at you, but I feel my comments along these lines might be it. I'd feel like getting my 4 day pass turned down was retaliatory. It is a pretty small thing to ask, especially for something as basic as your career. I'd want to fix that. I just don't know if it is a fixable problem, because of it's relationship to the 1st problem.

I do think it is somewhat important that you do understand that nothing about what you wrote suggests, to me, that you're being negative or unreasonable or anything about all this. I see nothing in your post to attack, so a little surprised I managed to. I think I just see a bigger problem hiding in the problem you are looking help for. Perhaps it'd be better to not comment on it if not directly asked /shrug.

It is unusual for the MEB to add things that aren't profiled. They do get your VA exams, and do a little bit of reconciling the NARSUM to the exams, so it's not entirely unheard of, but quite rare. The IMR and/or rebuttal will probably have to be used. The PEB does disagree with the MEB on occasion. From the examples I've heard, they will send back the record to the PEB if they want something added.

Let's take a minute and BREATHE. We are here to help folks and if someone is out of line or doubting another's issues or circumstances, that is not the point. On the other hand, if there is a mistake or misunderstanding, also, credit the point that someone answered your posts. I don't countenance disrespect on anyone's part. I also do not have a problem with folks responding to what they perceive as belittling them (within reason). This place is not for fighting or getting into jabs at each other. If someone is trying to help, but is not, I think the best response is to ignore the comments and or agree that no further response is welcome. I really have little to no interest in acting as a referee here. Maybe folks have rubbed each other the wrong way. Whatever...my point is that this is not a place to get into conflict and while I will let reasonable discussions go on (including disagreements), I will quash unproductive or unhelpful conflicts. My rules and I think that is for the best.

Know that while it seems you have had a bit of angst and distaste for @scoutCC's response, he has helped countless folks here and in my estimation only wants to see you and others get a good outcome. Not sure I get this question, but, I will take a shot given what I think the question is asking.

The PEB determines your unfitting conditions and applies whatever rating is supplied by the VA. If you disagree with the IPEBs fitness determinations, the method to challenge this is to request a FPEB and argue for the addition of other conditions as unfitting (at which time, if successful, the PEB would apply the current VA proposed ratings for that additional condition or conditions). If you want to challenge the ratings, you should submit a "one time VA Rating Reconsideration Request.

Does this make sense and/or answer your question?

As to your other/earlier issues, once placed on MEB you should not be going on TDY outside local area without approval of PEBLO/MEB section. Commander's generally trump everything, but, this is the general rule. It has been awhile since I have dealt with this specific issue, but, I will try to hunt down the AR that says this.

No worries man, and I see what you where getting at with this post. And I thought the same thing about S1 recieving a copy of my profile and letter, but their stance is that they want it from my PMS and not me which is pretty retarded since the info is still the same. And my bad for jumping off the rails on your response. I was pretty hot about this whole process because I busted my ass in physical therapy after my injury, going from being in a wheel chair to fully functional and not to mention sucking up and dealing with my PTSD issues to be a team player. So having been a top block performer my whole career as an NCO and Officer to being treated like a scab.

I know this is a little off point, but from going from the guy getting awards for saving lives on the battlefield and being recognized as the number 1 company commander in your brigade to being treated as a shitbag because your being med boarded out for injuries you acquired in the line of duty makes a person angry and bitter. So I apologize for my remarks, I was pretty hot when I wrote my post and when I read yours so I probably read something in it that wasn't there.

This is tricky. The IPEB or FPEB can find you unfit for any condition but it has to be conditions that the MEB put on the 3947 as "does not meet retention standards". In my case, I was eventually successful in getting a new diagnosed condition added as unfitting but the PEB was forced to remand my case back to the MEB to get it added to the 3947 so that the PEB could find it unfitting. That was due to a lot of appealing and a second set of CP exams. Had the VA not done that second set of exams, the PEB would not have changed their opinion and the outcome would have been far different.

Example: MEB finds you meet retention standards for PTSD but that you do not meet retention standards for back injury. The MEB will specifically state this on the 3947. Fast forward and VA rates your PTSD at 50% and back injury at 30%. Now the PEB cannot change those percentages, but what they will likely do is offer you 30% DOD for. The back injury only. So you'd be sitting at VA 65% and DOD 30%. You could request and FPEB if you feel the PTSD is unfitting, but if the 3947 states that it meets retention standards, then it is a long shot. To get the PEB to add it as unfitting and raise the DOD percentage they would have to send it back to the MEB, which the PEB is extremely reluctant to do. If on the other hand the PTSD is on the 3947 as not meeting retention standards, then you would have a good shot at getting it added a s unfitting by the peb. You would just have to show them the evidence that it is unfitting.

The treatment by Army leadership is just terrible. I was in a similar situation, went from being #2 of 54 company commanders in the BDE, 3 ACOMs in a row in 3 years of company command to getting a really poor final OER. I wasn't treated as badly as you currently are but the treatment is a very bitter pill to swallow. I was treated way worse by my doctors than by leadership. I will always remember my referral to Walter Reed where I watched as numerous double amputees ambulated nearly perfectly on thier state of the art prosthetic legs, while my real legs caused me to stumble around like a drunk, and all the Army COL neurologist could say was that he thought I was embellishing my symptoms. He didn't order any tests or labs, he just completely wrote me off. That when I realized that the Army's Wounded warrior program was a sham and that they only took care of those with missing limbs, IED or other combat wounds and didn't care at all about the with a disease or injured in training (vs battlefield). When I realized the Army didn't care about me, then it became easier for me to stop caring about it and turn my focus fully to myself, how to get the best outcome in my case and salvage whatever I could from my 17.5 year career.

It's a shame that service members are treated this way, with doubt and disbelief. After sucking it up for years, I think we all deserve better. I chose not to fight it and in the end, I was selected for Major and resident CGSC/ILE something that only the top 30-40% of Majors achieve. I felt like that and getting PDRL and high percentages at the very end of my year long IDES case were my victory. That last crappy OER will go in the trash can and never affect me in the slightest.
 
The treatment by Army leadership is just terrible. I was in a similar situation, went from being #2 of 54 company commanders in the BDE, 3 ACOMs in a row in 3 years of company command to getting a really poor final OER. I wasn't treated as badly as you currently are but the treatment is a very bitter pill to swallow. I was treated way worse by my doctors than by leadership. I will always remember my referral to Walter Reed where I watched as numerous double amputees ambulated nearly perfectly on thier state of the art prosthetic legs, while my real legs caused me to stumble around like a drunk, and all the Army COL neurologist could say was that he thought I was embellishing my symptoms. He didn't order any tests or labs, he just completely wrote me off. That when I realized that the Army's Wounded warrior program was a sham and that they only took care of those with missing limbs, IED or other combat wounds and didn't care at all about the with a disease or injured in training (vs battlefield). When I realized the Army didn't care about me, then it became easier for me to stop caring about it and turn my focus fully to myself, how to get the best outcome in my case and salvage whatever I could from my 17.5 year career.

It's a shame that service members are treated this way, with doubt and disbelief. After sucking it up for years, I think we all deserve better. I chose not to fight it and in the end, I was selected for Major and resident CGSC/ILE something that only the top 30-40% of Majors achieve. I felt like that and getting PDRL and high percentages at the very end of my year long IDES case were my victory. That last crappy OER will go in the trash can and never affect me in the slightest.

Wow, it definitely seems that the "ill" treatment for DoD IDES participants is wide-spread throughout all of the military branches unfortunately. :(

Hmm, it would seem that I could probably write a best-selling novel with the DoD IDES & Army Command experiences I endured as a Senior O-5 from a 32+ year military "stellar" career. :eek:

Hence, upon acceptance into the DoD IDES, the instant "non-performer" perception became a reality in the eye of many and I was now wasting the Command's time. :mad:

As such, I had to fight my O-6 rater's bias & erroneous comments on my final (e.g., retirement) officer evaluation report while being a "Referred OER" albeit I didn't deserve an automatic below center of mass "sh*t-bag" evaluation!

In short, I was indeed successful and received a "Referred OER" written with honesty which allowed me to write an inclusive three-page rebuttal describing my physical and mental impairments effecting military duty performance; a non-Referred OER would not have given me that opportunity.

Nonetheless, please continue to persevere so "that in the end the juice is worth the squeeze." ;) Take care, brother!

Haven't followed this thread and this is my first look at it. So, my comments or views may not encompass all that has gone on and I may be missing context that said, here are a few thoughts:

As to your other/earlier issues, once placed on MEB you should not be going on TDY outside local area without approval of PEBLO/MEB section. Commander's generally trump everything, but, this is the general rule. It has been awhile since I have dealt with this specific issue, but, I will try to hunt down the AR that says this.

I know that at the very beginning of the MEB process- first contact- I was sent a bunch of forms to fill out, sign, and bring with to the appointment with the PEBLO. I remember one of the papers that I had to sign was that I had to be available, no leave will be granted while in MEB, but if leave was already approved, they can work around it. They want you local so they can contact you and you have maximum time for all the steps- legal to review NARSUM, write a rebuttal if necessary-
