I am trying to figure out if I should go for a formal PEB in my situation. I was given 10% DOD and 100% P&T VA. My conditions are following:

Unfit:

10% for lower back pain (retrolisthesis)

Fitting:

Cervical Strain (10%)
PTSD (50%)
Radiculopathy (40% 20 for each upper extremity was added by VA)
Radiculopathy (10% each leg related to retrolisthesis)

TIS: 12 Yrs
Rank: CW2
Spouse and 2 children
Blended Retirement System

All injuries can be linked to combat injuries.

I'm just trying to figure out if I should just take the lump sum and leave or not.

Any help would be appreciated.

Thirty percent or more from the DoD as a disability rating is required for retired status and potential CRSC. The following outline shows info we would need for almost any CRSC scenario and an estimate. @Provis and @chaplaincharlie might be able to assist you with your other questions.

We look forward to assisting you with a CRSC estimate. About 50% of those who request an estimate, do not provide adequate background information. We have tried to anticipate what info is needed for each scenario and the following outline is the result. We will not be able to provide an accurate estimate without this info.


CRSC Estimate

The following is needed for someone to compute your CRSC:
Accurate information needed within one reply:

1.--Average high three for basic pay (total of the highest 36 months of pay divided by 36)
Example reply: The Gross retired pay on my DFAS RAS is $2900.
Example Reply 2: The total of my highest 36 months of pay divided by 36 is $3600.


2.--DoD disability percentage
Example reply: My DOD disability retirement (Chapter 61) percentage shown in my retirement orders was 70%.

3. --Active duty years and months (or active duty equivalent for RC members which is total creditable points divided by 360). Your retirement orders will show your active duty equivalent on page one, about 3/4 down the first page as “Disability Retirement”.
Example reply: My active duty equivalent shown on my retirement orders was: 9 years and 8 months
Example reply 2: My total creditable points for retirement divided by 360 results in: 9 years and 8 months

4. --VA compensation (All of the following):
a. percentage; Example reply: My VA Compensation percentage is 80%.
b. amount; Example reply: The amount of my VA compensation is $1900.
c. dependents by category and ages of dependent children.; Example reply: My dependents for VA compensation are spouse and 2 children under 18.

d. Also provide information pertaining to any SMCs you receive.
Example reply: I receive SMC-K.

5.--Projected or approved CRSC percentage by your service.
Example reply: My approved CRSC percentage is 70%.

6.--Whether you qualify for another type of retirement . Cite the type of other retirement for which you qualify such as reserve component at age 60. Example reply: I also qualify for a reserve retirement.

7.--Did you receive a REDUX/CSB payment? If REDUX was received, then all the info (amounts and description) on page one of your DFAS RAS is needed in addition to other info requested. Please show a description for each item. Example reply: I did not receive REDUX/CSB.

8.--Did you accept the Blended Retirement program option? Example reply: Yes I was under the blended retirement program.

Can you provide all of the VA conditions and the ratings? Is the 10% Unfitting condition listed as combat related by the PEB?

Lastly regardless of the answer for those 2 questions I can't see how a 50% PTSD rating would be fitting. By definition most MOS's in the military would be unfitting with a 50% mental health rating. If the PTSD was considered combat related by the PEB if added and that back issue was not then you would gain tax free status on federal taxes by getting it added in addition to Tricare which is invaluable. I would try to get PTSD added.

Here are the VA conditions

CPAP - 50%
PTSD - 50%
Radiculopathy (left upper) - 20%
Radiculopathy (right upper) - 20 %
Cervical Strain (DDD) - 10%
Lumbosacral retrolishesis - 10%
Left knee - 10%
Right Knee- 10%
Bilateral Plantar Faciitus - 10%
Tinnitus - 10%
Right lower extremity - 10%
Left lower extremity - 10%
Hammertoe - 0
Hypertension - 0
Headaches - 0

The unfitting condition of DDD of the lumbosacral spine is listed as incurred in a combat zone or incurred while performing combat-related operations.

I am not sure how you are 100% VA P&T as those numbers put you at 93% which rounds down to 90%. Are you TDIU? You may want to double check everything. The reason I asked was because if you were still 100% without the 10% unfitting then you don't have pay back the severance through recoupment. However if the one 10% unfitting condition is designated as combat related by the PEB then it wont' be recouped by the VA so you are good to go on that front.

Now the main reason to fight to have 1 or more addition conditions added. You won't qualify for CRSC if you don't have a total of 30% DOD. CRSC is only available for those who retire and not those who are separated with severance. Now the good news. You are in better circumstances than most. You get a tax free severance with no VA recoupment that gives you a big check, and around $4,000 a month tax free disability income + CHAMPVA as your worse case scenario. The downsides is the VA could lower your ratings in the future P&T doesn't guaranteed that won't happen.

I would absolutely try to get PTSD + both right and left Radiculopathy added. Then you can get your Chapter 61 retirement, CRSC & Tricare for life. That seems to be a much better option! You need to request FPEB and work with your IDES attorney to gather evidence int he meantime. Your Chapter 61 IDES attorney can submit a written appeal before the FPEB and if its strong the PEB may grant your request without a hearing to save them some time.

Talking to your attorney is a wise choice.
