0% from VA for Cancer

See.........they used my DD-214 from when I left active duty in 2011. I have yet to get my DD-214 for my ANG service because I am still in hence the title 10. Yes, I have 12 years active and 5 ANG.

Yes, because that was for the fully developed claim that you had filed. Now you are going to be approved for (at the minimum) TDRL at 100% from active duty. They may choose to put you on PDRL because you are stage IV and it is considered incurable.

Where I see the fight being is getting the original claim approved to the date of filing of September 2015. That is 12 months of C&P benefits that you do not want to leave on the table.

Talked to PUEBLO today. EPTS, discharge only. Funny, I have 17 years in. FPEB here I come.

How is the cancer linked to your military service? If you can find a direct connection, that might help.

I shouldn't have to, they signed the LOD.

It's all about Service Connected!

There's Service Connected.
And non Service Connected.

I'm sure you already know that. I wish you the best of luck.

The LOD service connects it....../
What's on Second and I Don't Know is on Third.

Sooooo, maybe wrong forum but here it goes. At what pay rate will I get? My 359 shows 13.36 years of title 10, but I was commissioned 17+ years ago (due to ANG service), I'll get 75% of what? O-5.

Your highest 3 years of earnings. Whether they use your highest three of active duty or the highest base pay rate for your last three years of service depends on what code they retire you under (1201,1202, etc.).

You will get 75% of the 0-5 pay average for the last three years (assuming you are 05), of that, at least $3000 of that will be tax free (VA offset).

Retirement pay should be somewhere near $6200 per month, with about $3000 of that tax free.

I don't see any codes on my 356, maybe I'll get that later? And the VA rated me at 0%, I'll fight for it but it doesn't seem right.

First off, I am very pleased to see that you got a 100% rating from DoD and VA. That was what should have happened based on what you had written previously. (You may still have claims or issues on the VA side with date of entitlement that may impact what you should get in the final calculation).

Your retired base pay is based on the High-36 calculation (this is from the DoD FMR Vol. 7b which you can access here: http://www.pebforum.com/site/resour...ry-pay-policy-and-procedures-retired-pay”.83/ ):

010102. Retired Pay Base The retired pay base is determined based upon the date the member first entered military service and whether the member is retiring under regular, reserve, or disability provisions of law. Details are in Chapter 3. A. The Date of Initial Entry into Military Service (DIEMS) determines whether the retired pay base is the monthly basic pay of the member just before retirement or an average of the highest 36-months of basic pay applicable during the member’s career. 1. Final Basic Pay. For members who first entered military service before September 8, 1980, the retired pay base is generally the final basic monthly pay that the member is receiving at the time of retirement. 2. High–Three Average (High 36-Month Average). For members who entered the military service on or after September 8, 1980 the retired pay base is generally 2BDoD 7000.14-R Financial Management Regulation Volume 7B, Chapter 1 * November 2015 1-5 the average of the highest three years (36-months) of monthly basic pay to which the member received for any 36-months of active service whether consecutive or not.

I don't know what you mean by the VA rated you at 0%. You said in your post signature block that VA rated you 100%. Do you mean for 0% for one condition?

In any event, best of luck in retirement! Congratulations on your deserved retirement!

Jason, the DoD gave me 100% and was very specific the VA hadn't given me anything. When I logged into eBenefits, the VA showed 100% rating, not service connected, so basically 0 money. About a week later I logged into eBenefits and it showed the normal 100% rating, service connected. What a journey.

It's 1201, what does that mean?

It's 1201, what does that mean?
In short, it means "Upon a determination by the Secretary concerned that a member described in subsection (c) is unfit to perform the duties of the member’s office, grade, rank, or rating because of physical disability incurred while entitled to basic pay or while absent as described in subsection (c)(3), the Secretary may retire the member, with retired pay computed under section 1401 of this title, if the Secretary also makes the determinations with respect to the member and that disability specified in subsection (b)."

As such, please reference URL https://www.law.cornell.edu/uscode/text/10/1201 for detailed information. Take care!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"

Best Wishes!
