10% DOD | 30% VA TO 100% P&T | APPEAL TO PEB SUGGESTIONS FOR DISABILITY RETIREMENT & CRSC | TRICARE OR CHAMPVA OR VA CLINICS ?

Hello,

I was medically discharged (honorable) and combat related.

The PEB SAYS Disability was incurred in a combat zone or incurred .... while VA rates was 30% this was in 2011. E-5

My DD214 says DISABILITY, SEVERANCE PAY, COMBAT RELATED ENCHANCED AS A JEA CODE WITH HONORABLE DISCHARGE (MEDICALLY SEPARATION).

Fast forward, I received a 100% P&T SMC with a spouse and a kid.

Do i have a chance to appeal to PEB to upgrade my DOD 10% to 40% due to a 100% P&T SMC currently?
I would like to know your thoughts and see if I should do that, to get a disability retirement and if i can have CRSC along with the disability retirement or CAN i apply for CRSC without a disability retirement if I have a combat related record on my PEB and DD214. And how much would I receive for CRSC?

I want to know if it's worth appealing for an increase in the military disability rating to attain a permanent disability retirement with VA disability and CRSC.

What is the difference between CRSC and CRDP? MY DOD says 100% DISABLED VETERAN (INDEFIN and is not a medically retiree with 100% disabled veteran combined.

And how can I qualify for TRICARE? Does Champva offer Champva for myself? My spouse and kid gets CHAMPVA but I have no clue if I am using VA Tricare or Champva or what insurance do I use if I'm a 100% Disabled Veteran Permanent and Total. Do I get Champva insurance or Tricare or will it only be through VA Clinics/Hospitals?

First of all, unfortunately, you cannot appeal the PEB findings as it's a static point in time, that's why the VA's numbers can go up, down or stay the same: the ongoing changes to service-connected conditions. Second, you have to be a retiree, whether disability or length of service to qualify for CRSC. Third, you have to be retired for Tricare as well. If you're 100% VA, you're using the VA, nothing else basically. The VA can refer you to civilian healthcare on an "as needed" basis, i.e., no specialists within a certain distance, no appts within a certain timeframe, etc, etc.

I'm assuming you were Army, and if that's the case, you would have to appeal to the ABCMR (Army Board for Correction of Military Records). There are very specific timeframes that things must be done. However, if there were errors on the part of the PEB at the time, that's one thing, however, just because the VA upgraded your ratings is not cause enough I hate to say. Sorry :(

CHAMPVA is for veteran's dependents, not the veterans themselves if I remember right. The Community Care Program will refer you out to the community
 
You can also use the Va choice program to get civilian health Care referrals.
