Adjustment Disorder 5-14 question

Hey all,

Here out of share anxiety. Looking for some clarification based on my situation. I’ve been recommended for separation under a 5-14 (Adjustment Disorder) and possibly for a personality disorder as well.

Adjustment disorder has lasted 7 months of treatment now, with no improvement despite monthly BH visits, meds, and therapy.I’ve been hospitalized multiple times, totaling over 60 days — one stay was over 30 days straight. Currently in an outpatient behavioral health program. On a 90-day temporary profile with no ETS, PCS, weapons, etc. I have severe occupational impairment and am unable to perform my job.

My understanding is that adjustment disorders typically don’t go to MEB unless they last longer than 6 months and impact duty performance — both of which apply here. But I’m being told 5-14 separation instead.

1. ⁠Does this sound like it meets MEB criteria?
2. ⁠Can they still recommend a 5-14?

How long have you served? Active or Guard/Reserves?
 
Close to 6. AD. 5 months from ets.
Okay. Then its possible to be chaptered out since you haven't served 8 years yet. I would rather ETS than be chaptered. A lot of mental health diagnosis are wrongly labeled personality disorders etc and are chaptered out. If your mental health conditions are from serving which they could be or existed prior to service as they are stating if they wanting to chapter you out than its still possible for them to own it because chances are serving has aggravated your mental health especially if you entered with no symptoms or diagnosis.

I would consult with some private attorneys. They can let you know if you have a case and the regulations that may be on your side. I would definitely want to be medically separated or retired if not ETS. Chaptering someone at 6 year mark seems like B.S. I will send you some references. See what they say and if you have a case. If so, it may be worth getting on on retainer to help you fight to get the right thing. If that right thing is IDES then you could possible get severance or a medical retirement which gives you tricare for you and your family for life.
