I am currently under a dual process with a chapter 14 and a medboard was that was complete. If the cg chapters me , i receive a gen under honorable. has anyone been in this situation where they are chaptered rather than medboarded? How was your transition to civilian like? Was there a big difference between the medboard and the chapter?
 
A general under honorable is still considered a satisfactory discharge believe it or not you qualify for all Veteran benefits but the GI Bill. If the medboard included a medical retirement instead of medical separation I figure the difference is quite substantial. We have had many in this situation but few return to update us on their final disposition.
 
I would receive a severance package as I'm only 20% DOD disabled but 80% va disabled. Any big differences? I know I qualify for voc rehab.
 
No big difference because you are required to pay the severance back from your VA computation unless the 20% was for a combat disability. So really nothing happens here either way you are walking away with your 80% VA rating and the ability to work around the gi bill ban by taking voc rehab.

I was in this position. The CG actually opted for the admin sep, I think, because my med board narrative statement commander comment was pretty dick. He wrote he didnt think mental health conditions were any contributing factor to misconduct. Luckily I haf copies of my medical records and a psychological assessment that stated they were a significant contributing factor so i sent that up to the unit JAG, through my army appointed trial defense guy, and they had to change it. So I guess check your medical records and see if theres anything you could use like that maybe.

Yea they cg wrote an order rescinding his orginal decision and directing medical retirement. No severance, med retirement 100% both sides. Im still in actually until end of june
 
How long did it take to receive the initial decision from the CG? I’m currently in the same boat, completed MedBoard and had my retirement orders for the end of April, then my Command decided to put me on a legal hold and pursue Admin Sep. Now I’m just waiting to hear on a decision from the Chief of Naval Personnel’s office.

I'm still in this process. Meb was complete mid Jan, transition called me on Feb 26, then on Mar 16 they put my meb on pause and my dual packet arrived to the cgs desk about two weeks ago. People say it takes a month but that's all I've heard.
 
My timeline was really dragged out, not 100% sure but thing i was done with medboard stuff like june or july last year but cg didnt make decision until december. Oh i think part of tge delay was the command scheduling admin separation board for me and a few others so that ate up like august, sep, oct... the cg for me is a 3 star that is constantly travelling too though. Anyway he made decision like a week before xmas but they didnt notify me until jan but decision was changed maybe a week later

Kind of going through similar situation. Your response I think sounds like mine... is it the same if you get a General (under honorable) via "resignation in lieu of adsep processing"? I am assuming so... only bar to benefits I see on the VA website is if you resign "for the good of naval service" which would be to escape a general court martial I believe.

Anyways, my situation is similar. Notified of probationary officer ADSEP, already have "Unfit" from PEB. Likely going to submit my "qualified resignation" in lieu of adsep for the offered General discharge. I will still submit a statement with the resignation form asking SECNAV office to consider the medical. Not sure if it will work... but General is better than an OTH if something went south (however improbable that is).

Any insight on VA benefits regarding the above or thoughts on action would be VERY much appreciated! Thank you!
 
I was separated with a General under honorable and life is great. 80% disabled receiving checks 45 days after separation. and im going to school with Voc Rehab. I did lose my gi bill and that sick MIAMI BAH i couldve been getting but it is what it is.
Did you have to redo all your VA paperwork once separated?

@kobralead Thanks for posting how it turned out for you. I think I will likely end up with the same. I am submitting a resignation in lieu of adsep... General discharge.
Glad to hear I'm not in it alone!
For your VA claims, what process worked for you to avoid having to go through all the same exams again and everything? Did you just file a new claim and they used the old exams/etc?

Its not bad at all man. I was extremely worried but it all turned out well and im sure it will for you as well. Get out here and make some real money man. They used my same exams and all they had to do was change my claim from IDES to a regular claim since it was already done.

Thanks man! My exams are almost 1 year old soon... hope it will still be okay!
 
Anyone following this or in a similar situation, CNP’s office said the earliest they’d have a decision back is January of 2021. This system is broken and I’m at my wits end. How in the hell you can keep a service member on Active Duty, at a terrible command, more than a year after he was already deemed unfit by a PEB for continued Naval Service, I have no idea.
Also, my Command didn’t forward along my statement to the CNP, who is the separating authority. I have my Congressman’s office helping, but don’t know how much they’ll actually be able to accomplish.
