Am I required to do new VA exams if I don’t want to?

Referred to med board, did all my QTC exams, signed my NARSUM and NMA, and my package was sent to the PEB in September.

This afternoon I received an email that the VA needs me to do new QTC exams. No reason was given, just “you have been scheduled for QTC exams”.

I do not want to do new exams. I am fine with the results of the QTC exams I did previously. If I do not attend these exams, can the VA just go by my previous exams? Nothing was wrong with them.

I am currently waiting on the DA 199 and after my proposed ratings the VA requested another QTC exam. It was an IMO and they finished it today. Mine was beneficial to me as it backed me. As for your question, the VA more than likely will not proceed until the exam is done. You may not have to go though. I had no meeting with a doctor or phone call, they just reviewed the evidence already present

Why did they need another doctor to review your evidence?

I had a surgery years and years ago so they wanted to know if it was the surgery "catching up" or the military's fault

I wonder why they needed another doctor if you already had a QTC exam?

My best guess is since the VA rates on service connection and aggravation is that the rater was on the fence on whether to give the rating or not so another doctor can provide his rationale on which way to move. I imagine it like your unfit status, they had at the very least 2 doctors vote on you being unfit to make it clear to get you out

I submitted 22SEPT21, and I finished all of my QTC exams in August, and then QTC wanted another exam to clarify a condition on December 9th since my previous doctor had conflicting documentation vs my medical file, and the new exam for me was to accurately describe my condition. So it happens. It won't extend your process out by months or anything like that. It's more than likely an exam to clarify your condition and make sure they are going to rate your condition properly, so it is in your best interest to go. The VA sees both sets of exams, and more than likely, the new QTC exam is for one specific thing, not the whole of your condition(s).

No, So they will review the exams and compare with your medical file. if your medical file shows good evidence that you have a condition, the VA exams are more so just to agree with your medical diagnosis. I doubt the new doctor would completely disagree with what the previous one said anyway. that’s pretty unheard of, but you can always file the VA Rating Reconsideration when you accept your findings if they tried to do something like that, and the VA will look at all the files again and you can submit more documentation then in support of yourself.

They can’t have one doctor say you have 100% and the next say 0% and they give you 0%, that’s not how it works. There’s definitely a lot of moving parts in it all, but I would say try to stay calm, and just go to the exams and see what happens and take it step by step. you’re gonna get through it!
