Formal peb board

Hey guys question, getting toward the end of the road with this process.I recently received 20 dod/90 va. I appealed the dod%, lawyer said I could probably get to 30% and get medical retired. didn’t work out I actually got knocked down from 20% to 10% so I’ll get separated with severance. My question is with me getting knocked down to 10% on the dod side, will my va percentage get changed as well.
 
Did you have 2 unfitting conditions and the formal board overturn 1 of them to fit? End of the day, VA rating should remained unchanged. Having 10% vs. 20% just means you pay back the severance pay at a lower amount. I would argue that if under 30%, the lower the DoD percentage the better.

For your formal board, were you trying to be found unfit for separate condition?

Yes one unfitting knee condition and I was looking to be found unfit. I was given two ratings for 20% for instability and 10% for pain on the va side. My lawyer said they just change from instability to pain and I’ll be receiving 10% instead of the original 20%
 
You're not the first person I have heard of going to a formal board and coming out with 10% after being rated at 20% DoD. I'm curious if this is being treated as a consolation price...sorry we aren't going to medically retire you, but we will hook you up and make you pay back severance pay at a lower rate ($152.64 vs. $301.74 per month).
 
If you agree with the board then there's really no difference from being at 10% vs. 20% on the DOD side.

Seems weird though if the referring condition was you knee and they only found part of the issue unfitting. If the knee is unfitting, it seems like both the stability and pain should be rated. Did they say the knee stability was fit but it was the pain that wasn't? I don't know you personal situation but there is one more appeal avenue prior to getting out. You can appeal the FPEB to your service. In the Air Force, it was SAPC.
