Initial MSC VA claim list too long ? (head to toe)

Hello all, I am new to the site, I have searched for the answer but did not come across the answer. I have talked to my PEBLO, legal office and random guys I know but I still don’t like the answer.

My list for the MSC is over 200 issues, everyone says my list is too long and talks about pyramiding but then the other argument is claim every single thing that you can. All my stuff is legit , example: I plan on claiming
TBI
TBI w/ cognitive deficiency
TBI w/ visual deficiency
TBI w/ speech deficiency
Migraine
Tension headache
PTSD headache
Exertion headache
Sinus headache
TBI headache

also Mental looks like
PTSD Chronic
Major depression
Anxiety adjustment disorder
Attention and concentration deficit
Memory loss
Dizziness
Anxiety
Nausea
Adrenal fatigue and so on.

I would just tell my list to my MSC next week when our call is scheduled but in my unit, everyone has the same MSC and there are nothing but negative stories associated with that person. I have heard plenty of pushback from this MSC from other soldiers and other professionals that have been involved in my MEB process up to this point.

thank you for the help,

B

I have 16 years Army and am being Med boarded for
PTSD
Migraines
Neck
Back and some more level 3 profiles.

so right off the bat, it looks like your mental stuff will all get combined into one overarching claim. if you look in the 38CFR none of what you listed is specifically noted so it falls under the general rating for mental. i would bet they group all of your TBI stuff together as well, and may link that to the headaches

Thank you for the reply, great information. Would you suggest just using only 38 CFR terms? Or how would you suggest I list my complaints, just want to have everything ready to go, my phone appt with the MSC is tomorrow ( just got the call for the appointment). I am just trying to not miss something that would not be grouped under each other. Thanks to all! This is a great resource, I wish I would have known about this forum before. I will spread the word to my counterparts.

so your MSC will do all of the work on this. They likely will have more listed for you than what you can think of. They found stuff in my medical records I had completely forgot about. That being said I would write down everything you can think of beforehand and check it off as they go just to make sure they didn't miss anything. I don't think you need to speak in 38CFR terms. IMHO they are more looking for frequency and impact from the Service Member. The docs "should" annotate everything in the proper terminology

Just an FYI. Your mileage will vary. My wife's MSC didn't look over her records or give her any suggestions on things to claim.
