Kansas HB-2036 -- Creating a property tax exemption for retired and disabled veterans

I realize Kansas isn't exactly vacation destination, but it is good to see any state adopt these exemptions for vets. If this gets passed like it is on track to do, this is going to save me thousands every year. E-mail your representatives in your states. This stuff doesn't just happen. It requires all of us to voice our desire to not pay taxes.


HB 2036 would exempt certain amounts of a homestead property’s assessed valuation for certain retired and disabled veterans beginning in tax year 2024. The amount of the exemption would be determined according to the disability rating for a service-connected disability from the U.S. Department of Veterans Affairs as follows:

Be it enacted by the Legislature of the State of Kansas:
Section 1. 
(a) (1) All homestead property owned and actually and regularly occupied and used predominantly as a residence by a disabled veteran or any surviving spouse thereof, to the extent herein specified, shall be and is exempt from property or ad valorem taxes levied under the laws of the state of Kansas, as follows:
(2) (A)
(i) Such homestead property used by a disabled veteran who has received at least a 30% but less than 40% disability rating for a service-connected disability from the United States department of veterans affairs, or any surviving spouse thereof, shall be entitled to an exemption of 60% of such homestead property's assessed value.
(ii) Such homestead property used by a disabled veteran who has received a disability rating of at least 40% but less than 50% for a serviceconnected disability from the United States department of veterans affairs, or any surviving spouse thereof, shall be entitled to an exemption of 70% of such homestead property's assessed value.
(iii) Such homestead property used by a disabled veteran who has received a disability rating of at least 50% but less than 60% for a serviceconnected disability from the United States department of veterans affairs, or any surviving spouse thereof, shall be entitled to an exemption of 80% of such homestead property's assessed value.
(iv) Such homestead property used by a disabled veteran who has received a disability rating of at least 60% but less than 70% for a serviceconnected disability from the United States department of veterans affairs, or any surviving spouse thereof, shall be entitled to an exemption of 90% of such homestead property's assessed value.
(B) Such homestead property used by a disabled veteran who is permanently confined to a wheelchair or has received a disability rating of at least 70% for a service-connected disability from the United States department of veterans affairs, or any surviving spouse thereof, shall be exempt from all such taxes.

I REALLY hope this passes this time around, but the Committee on Taxation has killed every VA property tax exemption bill that has gone before them for several years now. I will say, though, that this is the first year a VA property tax exemption bill has had multiple sponsors (12 this time!). Keep tabs on it here: KS - HB2036

The House Committee on Taxation recommended passing the bill! Hopefully the Senate will agree. I emailed my state rep to ask why it hasn't been introduced to a Whole committee and floor vote yet. It's been sitting since early Feb.

Maybe we will move to KS instead if this passes! Right now TX is the plan since property tax is exempt there.

There has been an update. Seems like it's going to pass! I guess I'll have to start looking for houses in KS again

Thanks for the update!! Looks like they slightly amended it but the intent is still there. 70% or above VA disability equals zero property tax. Now you can't get a homestead refund and property tax exemption. I'm actually okay with this. Just stop fucking taxing me to death. I'll deal with the rest.

I'm pretty sure this will be the most generous property tax exemption bill for disabled veterans out of all the states--to include TX and FL, which is saying something! Every other state, I believe, requires the SM to be 100% VA disabled in order to be fully exempt from property taxes. Great to finally see my home-state honoring their veterans in this way. As an aside, I predict MO will also pass their property tax amendment for disabled vets once it is passed here in KS (compete for vets). I believe they have a similar house bill currently in the works, as well.

I hopeful that the Senate doesn't do something stupid with this bill and try to tank it. I need to contact my Kansas state senator to let them know to support this bill.

for whatever it's worth, my nephew was a legislative intern in NY, and he said most state bills that is only an amendment and has precedence in other states, if it makes it to the senate they almost always get passed, especially if it had a lot of sponsors at the onset, which this one did. If I had to guess, they'll probably change the amendment to 100% VA disability rating to get the exemption while in the senate to make it in-line with other states.
 
Apparently they only really work for three months out of the year..... I fucking hate politics man. This whole process is complete bullshit.

That was a more broad based and all encompassing tax relief that got veto'd. The good one, HB-2036 has passed the house but is waiting on Senate work. This one doe not have income limitiations which is awesome. That one that Gov Kelly veto'd had an 80k total cap.
 
I am in Texas (I am from the South Bronx lol), and due to my rating, I do not pay property taxes, nor pay annual registration fees for two vehicles. Florida, Nevada, SC and Georgia (plus a slew of others) have similar veteran benefits. In my case, I'm saving $8400 a year.
