M-Day, deployed under title 10, possible PEB.

If anyone can help me out I would appreciate it.

So I’ll try to be as clear as possible. I am an M-day troop who’s deployed on tile 10 orders.

I really messed my back up on this deployment. Had some MRI’s done which confirms nerve issues, facet issues and all that junk.

I have an appointment with the Dr coming up soon and there is a high potential for a MEB/PEB to happen. I avoided it once before (the MEB/PEB) when I had severe back problems but now it’s worse & there is image proof.

My question is this,

If they do it, what happens to me? (Let’s assume I’m done for. Getting medically booted / retired and let’s assume I’m sent home many months before everyone else in my unit)

Do I go back to the MOB site (Texas) and sit there for potentially months until I’m given the boot?

Am I able to return to my home state but left on title 10 orders, continuing it be paid until I’m officially medical’ed out?

I’m just trying to get a clear picture of what would happen to me & what my income situation would look like because I have two little girls that I need to feed. If it matters at all, I’m going on 16 years of service & it’s not my first deployment.

They keep you on orders if put in IDES while on title 10 orders. You don't get much say in things. If your doc thinks the condition won't improve within 1 year and causes you to be unfit for duty then they put you in iDES. Then it depends on if your unfitting condition (s) equal 30% or higher. If so, you medically retire and get Tricare immediately for your family. However, any VA compensation you get will offset your chapter 61 pension. So most Soldiers only get VA compensation and Tricare. If you have conditions that were hurt in combat its possible to get extra compensation later after retiring via CRSC. CRSC is money you get back that you lost due to the VA offset up to the value of your earned longevity pension in the Guard or up to the VA pay tables of your CRSC% (you get whichever is lower)

I always recommend to hire a dedicated private attorney from the very beginning. They are expensive but if in IDES you have a lot more to lose if forced to medically retire before hitting 20 years AFS. If just a 20 year letter than its possible to come out ahead due to getting retired earlier than age 60. I will send you references for qualified private IDES attorneys. The first step is a permanent profile and then your doctor needs to think you can't do your job anymore due to that condition he or she is putting on proflie.

So I am actually already 100% P&T on the VA side from injuries when I was active duty, & from other deployments. From everything I have read I can request the LDES system to prevent a trigger of VA claims.

My biggest question is if this happens, will I be stuck in Texas (demob station) until the PEB is complete? Or will I be able to go home, continued to be paid on title 10 orders while I attend appointments? I won’t be able to resume my job back home as a miltech due to the back issues so I’m worried about a steady paycheck until the PEB is complete.
