Good afternoon,
Just looking for some advice on my case:
- was referred to meb for chronic knee instability and peroneal nerve damage/foot drop from associated knee injuries and failed surgeries
- VA C&P exams are complete as of last week. For my knee I was rated as pain with motion, extension to 10%, and severe instability with a prescription for a brace in my file (should be rated at 20%)
- deep peroneal nerve paralysis (incomplete severe - should be rated at 20% according to Va master list)
- ankle ROM 0% flexion and extension - also hopefully will be rated at 20%
My question is I can find unfitting criteria in ar 40-501 for Internal derangement of the knee. But have not found an unfitting condition for the nerve damage I have and was also wondering if my ankle condition, due to limitation of ROM will be listed as unfitting even though it was not one of my referred conditions for the MEB. Since I am unable to find anything in the AR for the nerve I’m just curious if it will be rated in my medical retirement consideration by the PEB. Just want to get past that 30% DOD!
