Medically retired Active or reserve?

I was a reservist with 18 years 9 months. I was recalled to active duty and injured. I went through the whole LOD/PEB process and found unfit for duty. I was medically retired. My retirement letter says I earned over 18 years of service for a Non-regular retirement and was in a drill status when determined to be found unfit by PEB. So here is my issue…. I was issued an active duty retired ID. DON says I’m reserve retired and entitled to pay when I’m 60. DOD says I’m active duty retired receiving pay, though I’ve never gotten pay. So which is it? Or how do I find out if I’m entitled to pay? No one seems to have an answer.

What percentage DOD Disability retirement does your retirement orders show? A rating of 30% or more entitles you to retired pay, but it is reduced dollar for dollar in the amount of VA compensation received each month. A medical retirement is often called a Chapter 61 retirement. What VA compensation percentage do you receive?

If you have ”20 good years” for reserve/NG retirement, you could receive non-regular retirement once you reach the age requirement (normally 60).

How to determine if you are entitled to retired pay:
—Read the two preceding paragraphs
—Check your DFAS MyPay account
—Review your retirement orders (not letter)

My guess is your not getting retired pay because your VA disability pay exceeds your DoD pay.
 
There is no percentage of disability listed on my retirement paperwork. Literally has nothing listed. 15 of those years were active duty. I’m going to try to make some phone calls tomorrow but cant they be concurrent? Retirement/Disability?

Nope! You get one or the other. Also whether its Chapter 61 disability retirement or non regular retirement if you didn't do 20 years any money from the VA will offset your pension. So if your VA compensation is greater than your retirement amount you won't get any of your pension. Still always choose to receive VA compensation since its tax free.

did you ever get an answer as to who you needed to contact to get answers?
 
I did, I finally got connected with a PEBLO who broke it down for me. The next issue I ran up against was the advice the JAG gave me. He said if you go IDES, the board has to use the VA ratings. But if you already have VA ratings and elect for LDES, the board can choose to assign lower ratings.

I thought the whole point of LDES was that it's expedited for folks who want out quickly or already have VA ratings.
The PEBLO then told me no, that's not true. If you go LDES, the board will use your existing ratings.
Does not give me a warm and fuzzy feeling inside when the JAG and PEBLO do not concur on the process.
