Morning everyone!

My MEB legal rebuttal and personal statement were submitted yesterday on 11/06/23.

I was told that the PEB is backed up and to expect a few months before I receive a response.

I’m curious as to what others are currently experiencing as far as the informal PEB timeframe?

(I know every case is different- just wondering! )

What did you rebut? The time in between steps is good to plan for contingencies. For example if you did a rebuttal to add another unfitting condition you could gather additional evidence in case you need to request a FPEB.

For my NARSUM, 2 conditions were found not meeting retention standards, which I’m in agreement with.

Rebuttal:
-Requested 3 conditions be further reviewed for not meeting retention standards.
-To add relevant, diagnosed conditions.

As far as clinical records, I have been sending to my PEBLO, most recent being 10/30/23. So far, I’m up to date with that!

If you are trying to add an additional condition you can work on the evidence for FPEB since it will most likely need to go that route to get it added. The iPEB tends to agree with the NARSUM. Retention standards aren't going to get you all the way. The PEB is personnel driven. Try to get profile for that condition so that you have limitations to your job regarding it. Try to get doc statements etc. That kind of stuff. Hope for the best but expect for the worse is my motto during IDES.

Update:

01/23/2024
-Received the PEB DA Form 199 from PEBLO.
-Requested extension.
01/30/2024
-Met with lawyer.

-My decision needs to be made whether to concur with 20% DoD rating or appeal. DA Form 199.
-Timeline for appeal would be ~6 months (July) for the formal hearing.
-Due to this, and also my mental sanity, I am leaning towards concurring with the 20%. I know with 30% I’d be eligible for TriCare, however, I receive VA disability, VA healthcare, & have private insurance as well.
