PEBLO Drops NARSUM and then takes off on vacation.

I just got my NARSUM at 1130PM Wednesday night (DEC 20) with a letter stating I had 24 hours to reach out for an appointment to go over it with the PEBLO. Also stated I have 5 calendar days to provide my elections. I responded as soon as I got it that I was available and received an auto email stating that the PEBLO was out of the office until 29 December. I have received no response and I'm guessing at this point I won't. Anyone have any advice on recourse for this?

I'm pretty sure I'm just going to accept the NARSUM because it's what I expected/hoped, but it seems pretty messed up to drop a time sensitive document at almost midnight right before you go on leave.
 
Man, I'm sure some PEBLOs are decent but my entire experience with mine was horrific. This doesn't surprise me at all. Make sure you have saved email traffic with your PEBLO and DES Council (or private council) documenting the situation.

In my case - I was never notified of findings. I finally contacted my congressman to find out my findings were in (despite my PEBLO just telling me there was no update and to stop asking for updates).
 
Just send an email within the 5 day limit stating what you want. Print a copy of the mail and keep the email in case an issue arises.
 
When you receive your NARSUM, the clock on responding shouldn't start until you sign documentation stating you were counseled on a specific date and you have until a certain day to respond. See attached.

Other options are, if your PEBLO has an assistant contact them. Do you have the information for your lawyer? You're usually assigned a lawyer at the beginning of the process, they review your non medical assessment. Your PEBLO should have also forwarded everything to the lawyer. The lawyer will be able to submit an extension.

As stated in a previous response, keep the email traffic and request an extension. For extra protection, if you called anyone such as the person above your PEBLO, the PEBLO assistant, your lawyer, and/or the paralegal, include your attempts to contact with times and dates. Such as stating, on this date or these dates I called to request a counseling or an extension. Even if you agree with the findings you shouldn't feel rushed in reviewing everything, and understanding all your options, what they mean and the possible outcomes.

I am currently in a similar boat. I have to provide a response by 29 Dec, and the lawyer is on leave until next year.

Either way try not to get too frustrated, or stressed it seems pretty common for all the power players to drop the paperwork in patients laps then go on leave.

Thanks for your responses. I was able to get ahold of the lawyers and they are going to make sure I have an extension. I have a meeting with one on Thursday to go over everything.
