Opted into VA only before I got out. Medically retired march 31st and instead of getting VA compensation I am getting retirement pay.. can anyone please help with how to resolve this? Im imagining this is gonna lead to a head ache of an issue and definitely won’t get my first VA compensation check when I was planning on having it financially bills wise.

Did you agree to waive retired pay in the amount of VA comp received ?

That would be done on the VA Comp application form by NOT checking block 26.

The above is applicable to a CH 61 retirement with less than 20 years OR having a VA Rating less than 50%.

I only did 5 years TIS I should have clarified that at the beginning, I remember specifically selecting VA compensation only if I fucked up by not checking a single box or something is this an issue that is able to be fixed?

So I got my claim finalized a week ago. What they did was take the retirement amount that DFAS is going to pay out for my first month retired in arrears, and subtract it from the VA amount.

So Army will pay ~3k on the first, and the VA will pay ~1.2k. Then next month it should all be VA.

Then comes the CRSC process.

You select to receive VA compensation BY NOT checking block 26 on the VA compensation application form.

I cannot determine if you checked the box or not from your text. If you DID check the box you would not receive VA comp.

Yes, an incorrect/mistaken selection can be fixed . If you need instructions let us know.

Thanks guys, I really appreciate this website being a thing, this type of stuff is so niche it makes it harder to research correct information.

I'm looking at the Form. I don't see a BLOCK 26. it only goes 1-7

You are looking at the form that can be used to correct or change your choice made on your ORIGINAL APPLICATION for VA compensation. The original form includes block 26 and others.

I said:
If needed, here is the form *to correct/change an election*: added

Is this the from that DFAS sends you? I am looking at my separation paper work and block 26 goes into 27 with BRS??? So I think I’m looking at something different. I just want to be aware of this form that is mentioned at the beginning and mark the appropriate block!?! Thank you in advance

1. Normally, an application for VA compensation is on VA Form 21-526ez and that form contains the BLOCK 26 discussed here.

2. https://www.vba.va.gov/pubs/forms/VBA-21-526EZ-ARE.pdf <—LINK -21-526ez form several pages deep at this link

3. For most people, they DO NOT check block 26 and as a result they DO RECEIVE VA COMP

4. If the election was incorrectly checked or no election made, this is the correction form :
If needed, here is the form *to correct/change an election*: added

5. I don’t know what action you took on the original application form (see item 1), but if you still need to file a waiver of retired pay in order to receive VA comp, the form at item 4 is used.

6. DfAS usually does not generate VA forms. If you did receive a VA form from the DFAS, follow their instructions as it might be related to the election you originally made. I have received VA comp since 1991 and DFAS has never sent a VA form to me.

7. Recommend you visit with a veterans service officer for help in completing your forms.

Ron,

Thank you for getting back with me in a timely manner. I never filled a form out. My MSC pre populated everything during the beginning of my medical board. I haven’t had my exit interview not sure if that’s what we would finalize or not?

The exit interview as I remember it was just going over all of the programs available to you at the VA. It was something that I remember as being a waste of time. I can look everything up myself.
