Hello Everyone,

I'd like to get right to the point. I was medically retired from the navy on 29AUG14 with 30% DoD and 90% VA, or so i assumed. Now that I'm out my ebenefits is saying that my claim was closed on the 29AUG2014 which is fine. The problem was that I see there is a new claim started on the 15SEP14. I called the VA to find out what this meant and they told me that the original 90% isn't set in stone and that the VA is now reviewing my claim from my MED Board. I'm so confused on this situation. Can anyone give me some information, it would be much appreciated.
 
This is nothing to be alarmed about. Under IDES rules, the VA claim is not finalized until you are actually retired/separated. So, once you are out, they close the "old" claim, and normally just confirm it through the "new claim." Things CAN change. They rarely do.
 
That's is normal, what you receive prior to separating is proposal from VA. Once they receive your DD 214 they will relook and finalize your claim. I doubt you should be too concerned
 
Well neither of these gets to the point, it is actually 3 stages, once your out, they get your 214, they do a quick review and "close" the case. thent hey send you a letter about 3 weeks later to the effect of "we determined your case needed additional review" and you get some wonky "review of evidence" but "decision notification sent" and your contentions change from the long list to "ides" and then anythign that was deferred in the "original claim", basically what they are saying is that the IDES cases are under additional scrutiny due to all the bad press and congressionals filed, and they are basically appealing for you, that however does not stop you from filing appeals individually and uploading/mailing in additional supportive evidence, or evidence that needed additional highlighting to help you out. The good news is, this gets you another chance at a "fair shake" the bad news is, it is in the regular queue and not the ides queue so it will take some time. The upshot is, your getting paid at at least the first level while they do this vs others who are in the regular queue who are waiting for their first claim to ever be processed (non ides cases).

A has been previously pointed out it is procedural issue. I bet your not the only one that process has freaked out. Thanks for your service and best wishes in your retirement.

I'd just like to add that in my case, my original IDES VA came in at 90 or 100% IU/UI (sp?).

But when my IDES VA claim went into the post-discharge "finalization" process, someone at the VA found a mistake, and at the end, I received 100% P&T on my finalized IDES VA claim.

So the review can work to make sure the initial IDES VA claim is correct, and if the initial claim isn't correct, they can fix the error - if they can see it and have the proper evidence to support it.
