Timelines for Army BCMR? Honorable "Personality Disorder" to medical retirement for PTSD

I just received my AO a couple weeks ago and it was a complete shit show. The guy who wrote the AO used everything he could against me and my lawyer said it's complete B.S. but from the sounds of it the board usually sides with the advisory opinion I was told by my lawyer if they deny it then its on to federal court. I'm praying it doesn't come to that but it's blatantly obvious they will do anything to get out of awarding you what is deserved. Hate to be the bearer of bad news but my case was submitted September of 2017 and I just got my AO I hope yours goes faster and you have a more favorable AO. GOOD LUCK.

Hey thanks for your feedback I am sorry about your outcome please keep fighting all way to federal court don't give up I also hope you get what you deserve soldier. I see the AO carry significant weight. We all know they want to deny us due to saving money rather them give us our justice and doing the right thing for each individual case. I told myself to expect the worse even though my lawyer presented actual facts on error and injustice! I just want a decision soon so i can move on to federal court as well. Good Luck going forward.

I did two things I wrote my Senator John Joyce. Who was able to get them to admit when they recieved my records. Which gives me a time line which includes them not opening mail for a few months. I also talked with NVLSP. I understand That the bord has 18 months for 10% of cases but it should be responded to witn 10 months.- I’ll incuded where i am drawing this from if i can add pics. I plan to join the class action If i do not get a reponce After writing John Joyce or his replacement In May of 2021. That would be the time congress said They would have to respond buy for my case in perticuler otherwise they are in violation of the law at which time I will have my case added to the class action.
I though I updated this thread but I dont see my update. Though i would share so others can have an idea what on time as well. It took the army 3 months of not opening the mail that was sent to them buy the Air aforce On my case i dont know about others.
Hope this helps.

I was retro activity paid for a PTSD CLAIM thru VA 100% ServiceConnected approved Nov 28 2018.

Just now can go back to board of correction s right and prove to them that my PTSD rather is DUTY RELATED AND ON DESERVING MILITARY RETIREMENT due to there own abuse practices harming me..bc see I was only diagnosed wrongfully after being retaliated by my command who had requested sexual favors from me and in which I denied such offer and we'll then they illegal had me info I c8vil commuted to be at psych ward bc I blew whistle.
Now can I get retro active military as retirement pay of my va service granted proof now obtained?
I understand that this is an old post; however, it contains an important question that might not have been answered previously.

One can receive a retroactive effective date for retirement and retired pay, but a medical retiree must have the retired pay reduced dollar for dollar in the amount of VA compensation received. Any left over retired pay will be paid to the retiree. Often, there is zero residual retired pay.

If a disability retiree also qualified for another type retirement such as regular (i.e., 20 years AD) and had a VA rating of 50% or more, the waived/reduced retired pay could be restored via CRDP, not to exceed the dollar amount of the longevity portion of retired pay. There is also the possibility for CRSC which replaces waived/reduced retired pay and an individual does not have to qualify for another type retirement.

Here is an example of a common case:
--VA 2500; retired pay 2000
--2000 retired pay minus 2500 VA comp amount = zero retired pay

I've been waiting for 1095 days. I just recently received a letter thanking me for my patience and letting me know that it has been turned over to an analyst. I'm hoping it doesn't take too long, but from what I have been reading, not to expect much, but I am feeling hopeful!!

NVLSP Files Class Action Lawsuit Accusing U.S. Military Departments of Violating the Rights of Veterans to Timely Decisions on Their Life-Changing Applications to Correct Military Records

--Delays of More Than 18 months Said to Exceed Deadline Set By Congress--
It's Crazy. They say the hired alot of people to help with the case load in early 2020. Then mid year 2020, they said there no longer backlogged. And told my packet should be done with in a 18 mth time period but I'm still waiting. I have called NVLSP several times. No one calls me back or emails me back.

Hello @tayawllms

The National Veterans Legal Services Program is a private organization. Your comment about not getting a reply to your questions is a matter i have seen several times (concerning NVLSP).

They also have a Facebook page; you might try reaching them at: Log into Facebook

I have no answer to why your packet remains unprocessed at 18 months+. Perhaps COVID issues have caused delays such as at other places.

Good luck,
Ron

I submitted an application to the NVLSP online and they submitted it to attorneys who then went over the case. The attorneys said they would take my case after reviewing it. I've never received a call from anyone on my end through this, just emails. However, my PEBLO is the only one who has called me.

Anyone have a phone number to contact the Army BCMR?
They don’t have phone numbers, the only time they use phone numbers when your case is getting finalized, someone called me when my case was approved, I gave them too much headaches so they reached out and told me that I don’t need to send anymore emails because the case was approved, then they sent me the approval letter through a DOD secure drive link.

Hello, I have been trying since I got this information from you. I called and sent several emails. I even just dialed random ext numbers to contact someone. Still nothing.

Sorry…I have no control over their procedures.

Perhaps @chaplaincharlie can offer some BCMR insight.

Received an email offering Permanent Retirement with a percentage rating of 50%. Anyone that has made it this far, do you have any suggestions or thoughts on the next process?

Just curious on people's timelines from recieving their docket number to case being finalized. I would like to know recent cases I know this has gone around numerous times but the BCMR reading rooms are worthless I know they are stating 600 days to some people 9-10 months to others or they just dont reply to case status emails as they have with me. Does anyone know if there is a phone number you can call? My case was submitted through NVLSP so i can't look it up online. I'm curious how many people are submitting cases for an honorable discharge from a "personality disorder" to a medical retirement for PTSD? Any help would be appreciated.
It took me 12 years from the time
I first appealed to the ABCMR to finally get to the PEB. It has taken the PEB 5 months to grant my retirement. It is taking between 60 to 90 days for the Dept of the Army to process my retirement, which should start on March 1. Patience is necessary.

I took me three years and got 70% DOD medically retired, status has been changed from regular discharged ——>medically retired.

I then submitted my ABCMR package and I took me two weeks to get approved 90% from the first shot

congrats. Hang in there and you’ll be contacted soon by email or phone to complete the process. It’s a little bit annoying but since you got that far, don’t sweat it, you’ll be fine

Got a call from the APEB yesterday told me that my case has been there for 538 days, and that cases for PTS/TBI are taking on or about 600 days to complete. The man told me that my case was up to be boarded this month and that I should have an answer before August 1st. 5747 was the right number thanks FIST or sharing those comms with me.
Anyway u could send me the number to the Army bcmr please..??I'm not getting any reply through email. Thank you.
