Told outcome before FPEB

10% DOD and 90% VA. IPEB said unfit back in August. Requested FPEB. Today was my FPEB and I was speaking with my attorney before the hearing actually began and the board told my attorney that they would affirm that I am FIT for duty now. So I didn't take the gamble and waived the hearing and accepted IPEBs finding and signed DA 199. Feel like I just waisted 6 months waiting for this FPEB. Just to be told right before it began that I'd be found fit. Is this common?

It is common for the board to make up their mind before. That's why I always suggest hiring a dedicated private attorney from the start. They can talk with the PEB and sometimes sway them well before the FPEB. Sometimes a well argued FPEB rebuttal submitted before the actual FPEB can help you get the results you want. Or if you know your case is an uphill battle you can shape your case to add another unfitting condition so that you can reach your desired goal.
 
I know this is old but wow they already made a decision before you had your board? Seems terribly biased.
