WARNING! This is going to anger most if not ALL of you! re: retro pay

The problem on the litigation side is that the precedent has already been made by the VA: their retro pay only goes to their receipt date OR the date of the intent to file. I do not know if there would be a mechanism such as the intent to file or not regarding CRSC.
 
I think you might be wrong on this (specifically about the cutoff date). I don't think getting your application in before this memo gets you in the door, as the memo states; "for CRSC eligibility determinations made on or after the day of this memorandum", emphasis on 'eligibility determinations' as opposed to 'applications received'. I REALLY hope you're right and I'm wrong on this (I applied in June but I was medically retired in 2014). This is something I'd be willing to go to court over (the legality of determinations over receipt) but I don't know if there's a legal leg to stand on there. Are they allowed to base an effective date on their own speed/lack thereof in making eligibility determinations? That seems like an excuse to slow down the process (or, as you said, give an unfair advantage to USAF and USA claims over USMC/USN because of their larger backlog(s)).

Btw, by using the received date, it negates the time to process. And, no, the problem with the Navy is not a backlog, it’s the sheer lack of concern on their part to actually take care of the claims in a timely manner. The number of their claims is significantly less than the Army which receives 100-200 per WEEK
 
Anyone whose claim was acknowledged as being received by the service branches on 19 August 2025 and before should be getting their full retro pay. Anyone’s whose claim was acknowledged received o/a 20 August 2025 would only be paid retro to the date received by the service branches. @Bamboonga don’t forget, this is an “Interim Guidance”, it may or may not revert back to the full retro pay or just to the received date. That’s the current unknown and my source is the CRSC branch at Army so I’m getting it right from the horse’s mouth in this particular case.

Until you're on the receiving end, no one really knows. My FB group alone has over 9k members, granted, a lot of them are spouses or people going through IDES now. Also, that 100-200 number includes reconsiderations as well. There are so many that never knew about it and file years after which increases the sheer number of claims being received. But, yeah, there are a lot of people out there that still don't know about it, and that, my friend, is just sad.

Did you happen to get any more information on this subject. I’m 3 years out and mine is stamped for 30MAY25. Trying to see if I get all my retro or just back dated to 30MAY25. My effective date says APR22, if that helps.

When you say APR22 do you mean April 22nd or April of 2022?

Yours being accepted in May plus being less than 6 years anyway, you would have been good even with the Barring Rule in effect as long as it was accepted prior to 20 August 2025

I really feel like they’ve misinterpreted this and it doesn’t surprise me. What makes sense is your eligibility date should be your retirement date and these rules are in place if you’ve retired after the 20th. I wouldn’t not be surprised at all. Not the first time guidance was published with out actually providing any guidance

That’s how it should be, but seeing it’s an “Interim Guidance” setting the line in the sand to get all outstanding retro pays process does make sense considering how many thousands of vets are owed money, including myself. Remember: the keyword is “interim”

Iam surprised they did not give you your due as you retired as a Colonel. It seems weird. Did you apply past the six year mark I assume?

Yes, at the 10-year mark, actually. I'm more concerned with the rest of the folks than myself. I actually almost wasn't going to apply, but finally did thanks to the insistence of one @RonG. Glad I did :)
