Here is a link that might be helpful: New Retired Benefit Programs Note that the Combat Related Special Compensation guidance is not updated to reflect the changes for elgibility for those with less than 20 years of service that were implemented with the 2008 National Defense Authorization Act.
This upcoming week there will be a couple of Congressional hearings of interest on the Wounded Warrior front. The times and details of these hearings are below. I sent the message below to select members of these committees in hopes that they would address these issues at these hearings. I also sent it to my POC’s at DoD so that they could be prepared to address these issues and in hopes that it might spur them on to take more actions in getting them fixed. Unfortunately, I will not be available to attend these hearings in person but I do plan to watch or listen to them via C-SPAN TV/Radio or webcast or by any other means available. Mike Joint Senate Armed Services/Veterans Affairs Committees MEETING DATE/TIME...
Jason, if this is the wrong section to post this, I apologize ahead of time. I like taking things that are new to me very slowly. I need time to do as much research as I can, then even more time to chew it over and figure out what it means and how it may benefit me. Not knowing if I'm getting a second limited duty period within the next couple of months, or going to a MEB, I've been contemplating requesting the services of an attorney to handle my case. There are a few reasons for this, without going into the immediate benefits, that I'll list here: 1. The horror stories from everyone else I've come across online and in person when dealing with being medically separated, and then fighting with the VA. Almost all of these people...
I have been asked a couple times to explain what concurrent receipt is and how it works. Rather than put it in various threads, I thought I'd put it all in one thread in the General forum for all to see. The purpose of concurrent receipt is to eliminate the dollar for dollar offset retirees see. Presently all retirees lose $1 of their retirement for every dollar they receive in VA Disability Compensation. Under current law only those retired with 20 or more years are eligible for either program. Currently there are two types of concurrent receipt, CRDP and CRSC. CRDP: To put is simply is how DoD makes your retirement whole after the VA takes their part and is considered taxable income. It is also automatic. CRSC...
As a military person one of the most nerve wracking situations we come into is when we can no longer perform our duty as a result of injury or illness. At that point we are faced with going through the MEB/PEB process. While this process is nerve wracking due to the amount of time it takes and not knowing what your future holds, it is survivable. The MEB makes a determination as to whether you are fit or not fit for duty. The MEB does not make a determination or recommendation for the rating of your disability. If the MEB finds you fit for duty you can return to duty or if you feel you are not fit for duty you can’t appeal the MEB findings. If the MEB finds you not fit for duty your case will be forwarded to the PEB for...
Here are two versions of the House and Senate bills that are moving forward that would change benefits for Servicemembers and Veteran's. H.R. 1538 "Dignified Treatment of Wounded Warriors Act" and S.1606 "Dignified Treatment of Wounded Warriors Act" A few high points include a mandatory review of all military disability cases where the Servicemember was separated at 20% or less. This would only apply to cases decided since Sept. 11, 2001. I would rather see all veterans eligible for review, but this is a partial step forward. A requirement for the services to use the schedule for rating disabilities as applied by the VA and as interpreted by the US Court of Appeals for Veterans Claims (CAVC) (this is huge as far as ensuring...
I am a E6 in the Marine Corp with 10 years active duty, I did not have this medical condition before I entered active duty in 1996. I suffer from severe migraines w/aura and photophobia resulting in dizzy spells and occasional blackouts. I was put on limited duty back in 2004 for approximately 8 months, I told the neurologist they were under control with the meds because I didn't want to be put out so he took me off limited duty..However they have proggressively gotten worse to the point where I am depressed and have panick/anxiety attacks. I was dropped from training at DI school and now being relieved as a recruiter (good of service) because of this medical condition I was just recently in a car accident in a goverment vehicle...
What all do they look for in the blood tests at MEPS? I have been recently diagnosed with Hemophilia and I know for sure that it did not exist prior to joining the military. Is Hemophilia something they test for? The one I am concerned about is Hemophilia A Factor VIII. Right now I am on a roll doing some research and found that certain factors in my job can cause a person to develop this disease... It is a common misconception that it is ONLY a hereditary disease...
Better Pay for Combat-Related Disabilities? Tom Philpott | August 23, 2007 Bush Backs Separate Combat-Related Disability System The Bush administration is preparing a legislative proposal to present to Congress in September that would establish a separate and, under most circumstances, a more generous disability package for service members who are injured in war or while training for war, sources said. Under the plan, recommended by the Dole-Shalala commission, service members found unfit for duty as a result of combat or combat-training injuries, regardless of the number of years served, would qualify for an immediate lifetime annuity from the Department of Defense. Annuity amounts would be based on the formula used to calculate...
Below is a quick brief of what I have going on. My biggest concern is a dash dash dash rating. My Narsum has just been dictated and I have yet to sign it. I am a Soldier with the 10th Mountain Division for 6 years. I have made it to the rank of E-5 Promotable and held a position of that of an E-7 for the past 2 years. My PEB packet also has a Line of Duty that states degenerative Joint Disease. I don't know what other info you might need but I would like to know what I am up against. THnak you for your help. Here is basicly my med history. MED HISTORY 12 JUN 01— Seen at Charlotte NC MEPS and evaluated by 2 surgeons for right knee condition and stability. 22 JUN 01— Waiver for right knee granted. With a P2 given at entrance...
Hey guys, I've been through the whole process and got my med discharge, got through the VA claims process with a surprising amount of ease. My situation was straightforward: I was hit by a car overseas and knew I wouldn't be able to do my job or meet physical standards. However, my shipmate wants to know the difference between getting a medical discharge and just finishing out his enlistment. He has a back problem that's causing him to consider the med board route. One example of the difference is the discharge code (is that the right term?) where if he got a med discharge he may be eligible to NOT be recalled to active service. I know the Navy benefits are not very attractive compared to the VA, my monthly VA check is non-taxable...
AR 635-40, para 3-2, states, "Presumptions The following presumptions will apply to physical disability evaluation: a. Before and during active service. (1) A Soldier was in sound physical and mental condition upon entering active service except for physical disabilities noted and recorded at the time of entry. (2) Any disease or injury discovered after a Soldier entered active service, with the exception of congenital and hereditary conditions, was not due to the Soldier’s intentional misconduct or willful neglect and was incurred in line of duty (LD). (3) If the foregoing presumptions are overcome by a preponderance of the evidence, any additional disability or death resulting from the preexisting injury or disease was caused by...
