22 Yrs AD in IDES / IPEB

Good morning, couple of questions as I start the process of IDES / IPEB.

1. I am 22 years AD with issues diagnosed on AD that I am being med boarded for. VA is telling me these issues may not be service connected? Didn't make sense to me.
2. Should have 55% retirement pay plus whatever from the VA. If my issues are deemed combat related is there any way I can retire with more than 55%?
3. I have relegated myself to moving on from the military at this point. Is there anything I should know/do/expect throughout this process?

Thanks for your time.

Hello,

1. Your DoD disability retirement would be the higher of 55% or the DoD Disability retirement percentage x your average high three base pay. So yes, you could retire with more than 55%, however...
2. Your retired pay will be reduced by the amount of VA compensation. There might be residual retired pay that you keep, however...
3. CRDP will be limited to the 55% x high three average base pay, and...
4. The combination of CRDP plus residual retired pay cannot exceed the longevity portion of your retirement pay which is 55% x high three.
5. Summary, you are going to end of with an amount equal to the 55% figure. You also will receive your VA comp.

6. Combat Combat Related Special Compensation (CRSC). You might be eligible for CRSC but the amount you receive might be less than the CRDP discussed above. Additionally, it also has the same limitation as not being more than the longevity portion of retired pay and the combination factor of residual retired pay...like CRDP. See A Supplement to CRSC Information <—-Link

The things I would say it to go through the CFR linked below and make sure you claim everything with the VA.

Thanks for the replies.

Is there any way the VA could not service connect the issue I am being med boarded for?

I am not an expert in this area, but generally, the VA ratings are higher because they consider ALL service connected disabilities, not just those thought to be unfitting.

Service Connection applies to any disease or injury that occurs while on AD.
After 8 YOS diseases or injuries that existed prior to service are also covered.
An exception would be misconduct. You got shot robbing a bank, broke your back while DUI........

So your should be good at 22 YOS.
