60% DOD tldr, but 30% of that is stable. How will this play out?

You’re guaranteed PDRL at some point. You will be re-examined for the non-stable unfitting condition and that will determine your final percentage.

Is there any practical difference between 30 and 60 DOD?
 
There could be if deemed “combat related” for purposes of CRSC or perhaps CRDP if the Major Richard Star Act is passed. For me there is too, because I heave residual retired pay above the VA disability amount.

It won't be split out that way. Right now you are TDRL. Later, if you are found PDRL, you'll be given a percentage that is all PDRL. You can't be half and half. And, percentage is determined by the severity of the condition IAW 38 CFR, not whether it is temporary or permanent. I have seen 100% TDRL, and 30% PDRL. And vice versa.

Well, that's sort of apples and oranges. What I was saying is that you can't be both PDRL and TDRL at the same time. Like, your category is one or the othet.

What she's saying is, overall you are TDRL, but this condition here is considered permanent already, so you won't get reevaluated on that, so even if the other one currently temporary eventually gets reevaluated and if it goes all the way to zero, that first one is already P @ 30%, so you'll keep your retirement.

As far as that goes.... I'd guess she's probably right, but I've honestly never seen that before. If they really already have called one condition "P", just make sure they don't send you to re-eval for it.

@RonG can you clarify what you mean? I have definitely seen Navy TDRL at 30% and 40%.

If you are found unfit to perform your duties because of a disability that may not be permanent, you may be placed on the Temporary Disability List (TDRL).


Your retired pay will be computed using one of two methods:


  • your disability percentage (using a minimum of 50 percent for payment purposes while on the TDRL), referred to as Method A, or
  • your years of active service, referred to as Method B.

Your pay will be computed based on whichever is more beneficial for you.
