Admin discharge

This is my second post but I have more info now so I made another post. I also PMed Jason but I know he is very busy so I wanted to see if anyone else has advice. I haven't had a chance to talk to my ADC yet because they are working in court all week so I'm kind of freaking out right now. Anyways below is the message I sent Jason but wanted to see if anyone else could help.



I'm not sure if you have read any posts of mine but I will give you some background. I'm currently in IPEB part of my case. My MEB was started for Migraines, Asthma and Chronic Pain. I have other conditions also but I will just name a few that pertain to this conversation. My other conditions not on my MEB but on my VA claim are Menieres Disease (2x weekly frequency)and Shin Splints. My Meniere's has made miss work twice a week for the last 8 months.The other info on me is Air Force over 8 years (10 years).

The help or advice I need is I was notified yesterday that my commander is going through a discharge for PT failures and from my understanding this discharge will just sit there until my MEB/PEB is completed. Is that correct? Now with all the paper work I received one of the papers said that my PCM said I have no problem passing my PT test but my off base doctor for Meniere's has told me numerous times that it is impossible to pass my PT test because of the frequency of my Meniere's.

What kind of advice can you give me?

I also was wondering how to get my Meniere's Disease listed as an unfitting condition. My PCM would not list it as an unfitting condition because she already submitted the paper work for my unfitting conditions and she said it was too late. From what I have gathered I can try to get my Menieres added as an unfitting condition at the formal board. I had another coworker just have a formal board and his lawyer fought to add a unfitting condition and the board allowed it. What are chances of the board allowing my Meniere's as an unfitting condition.

As far as PT test failures, since you are already in IDES then they shouldn't be able to separate you unless its for misconduct. Check with your legal about that, to be sure. Not sure about adding conditions, sorry
 
It would help if you clarify missing two days a week for Meniere's? Is this an average? Do you miss the same days? Please expain in a little detail amd I might be able to help.

It's not an average I have missed a lot work the past 8 months. The days vary and some times they happen in the middle of the night and the medicine I talk sedates me and my wife calls into work for me. The Meniere's spells also have happened while I was at work and my wife has to come pick me up.

Appeal the MEB. Demand an impartial review and submit your concerns in writing to the MEB approval authority.

Depends on the facts, but it sounds like it should be unfitting.

I wish I could give some sort of quick answer that would set this all to rest. Unfortunately, this is a process and you have to work each step. Gather evidence showing how the condition impacts you and your ability to perform your duties and fight for your position.

I'm still learning like you as we go :). I did find out if you have an open MEB that you can still have an item added to it if it hasn't closed. This might be something helpful for your PCM who said it can't be added.....not sure if I understood it correct but here is the AFI.

Per AFI:4.68.6. Changes in Condition/New Condition in SMs undergoing IPEB adjudication.

4.68.6.1. If a SM, for whom an MEB case has already been sent to the IPEB, is diagnosed with a new ―boardable condition, the case may require a recall of the previously submitted case. If a recall is indicated, the MTF Commander or designee (SGH or SGP) will contact AFPC/DPSD in writing per AFI 36-3212, Chp 2, to request the recall.


Concerning your MEB being in the system I was informed in one of my posts by Jason that once its in the system you cannot be separated until it is completed. Its a dual action process I believe. From my understanding if your going through the process for an MEB and that MEB retires you....you won't be separated. But if you are MEB'd and the MEB is return to duty and the separations has been approved, then you are separated at the close of the MEB.

If your concerned with it I know your PCM can also do a Medical hold, if you need I have an AFI for it, but I believe your good since your already going through an MEB. Hope this helps some, I would reconfirm as I'm not 100% on my research quite yet, or maybe someone can confirm.

The AFI you mention is that the paragraph number or the AFI number. I tried looking up that number as the AFI but I couldn't find it. I will try to look again but would you have a direct link to it if I can't find it.
