CRSC Help!!!

My fellow Vets!

So I was medically retired at 12.5 yos, with 100% disability, with PTSD at 70%, tinnitus and rhinitis included. My official retirement date was 7May2022, I have submitted my CRSC application with all documents my MSC and legal team said I would need to submit. Army HRC returned my application with no action and stated that they see I am retired but they were unable to verify my retired pay account or the documentation of a VA Waiver form 21-651.
I spoke with my MSC and local VA and they stated do not sign or submit that waiver form because it is not needed with me not being a 20 year retiree and to resubmit my application to HRC as is. Has anyone seen this before?

Since you retired earlier this month, DFAS might not have had time to establish your retired pay account. I have seen cases like that.

A waiver of retired pay dollar for dollar in the amount of VA compensation is required to received VA compensation by disability retirees, (Chapter 61).

CRSC replaces some or all of waived retired pay. You might want to ask the MSC how one would receive CRSC if they did not waive retired pay.

They waiver of retired pay is usually accomplished by NOT checking block 26 on the VA claim form.

Recommend you submit the waiver form just to be safe...it is my understanding that it can be faxed to the VA. It is not sent to the DFAS. The DFAS confirms its existence via electronic sharing of information by the VA and DFAS.

Glad I went back and read @RonG ’s comment as I started to type exactly the same thing. Ron is 100% on target. You’ve been advised incorrectly by legal and the MSC, because of that, I am offering remedial training for them about CRSC, free of charge, of course :)
