Help with CRSC filing

I recently went through an MEB and was medically retired for PTSD only at 70% PDRL, but with an overall VA of more then 70% which additionally included some other issues as well as tinnitus. I've reviewed a few of the online CRSC resources, HRC webpage, and the DD 2860 but still have some questions.

1.My original VA rating sheet listed the PTSD rating at the end of the description as (PTSD - Non-Combat/Fear-Easing Standard) and the combat code on that page is listed as 1. The diagnosis is directly related to combat though, with lots of supporting documentation from my DD214, CIB, Valor Award, and documentation of events in C&P exam documentation. However, the DA 199 MEB proceedings does list the sections V1 & V3 as yes for both which states that the injury was incurred in combat. Will this discrepancy between what the VA rating sheet lists cause an issue with the CRSC claim? Would I need to contact the VA to try to change this code error before filing for CRSC?

2. Do I list other VA-rated conditions that were not conditions that resulted in the MEB? As stated above my combined VA rating does include some musculoskeletal issues that began before any combat deployments, however, the tinnitus did start while deployed with evidence from my C&P backing up that claim. Would I put down the PTSD diagnosis on page two, then add another page to add the tinnitus as well even though that did not result in the MEB?

3. The DD 2860 as part of its supporting documentation requests a retirement points sheet, shortly after my medical retirement date I had an Iperms notification which was a final updated retirement point sheet. Under the CUR SVC TYPE section, it now says TDRL where it used to say TPU as I was in the reserves. However, I am PDRL and this is shown on both my DA 199 MEB proceedings as well as my final retirement orders. Is this discrepancy going to cause an issue as well?

4. DD 2860 Section IV, D. (Date Awarded by VA) - Is this the date of the first decision letter was issued, or the first effective date of the date it was initially claimed?

5. On page two it talks about if any of the conditions that are listed to apply for CRSC are the result of a secondary, If I file for additional claims in the future whether a primary or secondary condition, would I need to reapply for CRSC with the updated conditions if they are rated service-connected for combat-related?

Thank you for any information

Welcome to the group!

1) do not worry about what the PEB nor VA show as being combat-related. CRSC is based on a different set of laws for the determinations. The fact that you have a CIB goes a long way in showing the causal relationship between PTSD and combat-related event(s).

2) Absolutely yes! CRSC is based on VA-rated conditions, not MEB/PEB :) And, yes, bottom of the page is a "Duplicate" button (or should be) if the form you have does not have that, I'm attaching the proper one that was actually just updated earlier this year (it should have "CUI" at the top)

3) No, it will not

4) Yes, sometimes the conditions get upgraded and the initial date and subsequent dates determine what your ratings are and what time periods covered. HRC will pull a current VA Ratings Code sheet so do not worry about trying to dig one up

5) Nope! All you would need is CRSC Form 12e and the updated VA Decision Memo, short and sweet for any subsequent claims.

If you're on Facebook, there's a link below to the group I run, a lot of great info there as well and currently have 6.8k members.

Hello,

Recommend you visit with @RetiredColonel-MikeT (a CRSC Ambassador) on those issues.

Congrats on getting a V1 and V3 as a yes for that condition. That will allow you preferntial treatment for hiring for government jobs and all of your chapter 61 pension is exempt from taxes!
