Honorable discharge change to medically retired

I have question in regard to changing my honorable discharge to medically retired. I’m not even sure if this is possible, but as the main reason I left the army was for medical reasons I believe that it’s worth a shot. I currently receive 70% rating from the VA from service connected injuries dating from 2008 to 2012 in Iraq. My back and knees are only getting worse with age and working is becoming less of a option at this point. So to the point of my question, is something like this possible if so Is there a form I fill out or do I need to get a lawyer? Are you able to pull medical retirement pay and VA disability if VA is at 100%?

DoD will not retire you based on conditions that have gotten worse since you retired (generally speaking). However if you can prove your conditions were unfitting at the time of discharge and warranted a 30% or higher rating then you can file with BCMR to adjust your separation status. It is a long process.

An attorney is not required, but may be desirable.
 
You need to 30% for an unfitting condition, not just 30%. You can check the resource section of this website for a list of unfitting conditions in your branch of the service.
 
Hello too all, I'm new to the group. I was honorably discharged from the US Army in 1 Nov 2016 from Active Duty. I endured a traumatic incident that I was involved in and resulted in being diagnosed with Adjustment Disorder with Depressed Mood and Anxiety in 2012, I went through therapy sessions and was given medications for a few months. I was not provided a PEB/MED upon discharge. When I discharged, my initial rating was 30% from the VA which was diagnosed as PTS. Currently, I have been going through PTS treatment and have all notes from my psychologist which is noted with traumatic event occurring in the military and my VA rating has increased to 70% static disability. Do I have a case in getting my honorable discharge changed to medical retirement? Thanks again!

Ok thanks. When did u submit the claim. I'm about to submit mine. I was denied crsc because I dont get retirement but I think I'm eligible for change
 
I submitted my claim in 2018 and let me tell you that it is going to take some time. My condition has since been changed to Stable and currently 100 P&T. I was denied crsc as well due to not being retired.
 
Well hopefully they will approve it. And thanks for the fast response. Well I guess I'll join the hurry and wait club. But the retropay hopefully will be well worth it
 
I'm praying for a great outcome and definitely that will be one hella retropay if approved.

Hi. My case is very similar to yours. What form did you use? Did you hire an attorney? I'm needing help on the correction request and the why part. any help is greatly appreciated.!
