Medical Separation and Admin Separation

I signed my findings this week, and I was found to be unfit, so I am getting medically separated now. The issue that is arising is that I am also getting administratively separated due to my refusal to receive the Covid-19 vaccination. I know that's a whole different topic and that's for a completely different time, but I am here mainly to wonder: which one will I get separated under? I am receiving an honorable discharge for the administrative separation so no matter what I will be receiving my benefits. I am just trying to understand which discharge the Navy will discharge me under.
 
How did this end up playing out for you ? Did they choose to separate you medically or administratively ?

Still no word on the decision. I have been waiting for over 3 months now and my medical separation date is creeping closer.
 
When did they send your finding to the board? Have you got your ratings back yet? Just be glad yours is classified as honorable, the Marine Corps has classified them all as general under honorable.

If you have not spoken to your PEBLO or an attorney here is what they told me . This makes you a Dual action case. From what they both told me was the the deciding power almost always separates the military member under the Medical board Separation. Hope that helps , in your case either way you will get all your benefits regardless of if they pick adsep or medsep due to the fact yours is classified as honorable discharge.

Yeah, I have my separation date already which is 29AUG22 and I got 20% DOD/60% VA. The issue is that I have not received any word and I could be on terminal right now, but my command has no clue what is happening to my admin separation. The Navy is still deciding if they want to override my medical discharge and force me out as a Covid-19 vaccine refuser.

Your command needs to reach out to PERS-832 ASAP.

It is just annoying because I am trying to get my life together and I have received nothing. I am just trying to get my shit together and I could have been back home and working at this point. Instead, I am just stuck waiting around.

I am in this category as well, awaiting a retirement date currently, but they can't overlook a service-connected medical disability. I've been told not to even worry about the Covid refusal stuff and that my medical board/retirement will come before they can even decide on anything. On top of that, my command has also told me that medical overrides anything else unless it was a serious offense that would be classified as a dishonorable discharge, so you should be fine.
 
And when you check this site out, Enlisted Separations
and look at each template, whether you greater than or less than 6 years, part of each of the templates asks if you are enrolled in the DES process, and if so, what your findings/outcome was, so I think anyone concurrently undergoing the PEB process/awaiting retirement or separation will be fine.

My admin said the same thing. The issue is that they have known about my separation date since 22MAY22 and have done nothing. I will be going in tomorrow to see if there has been any response or progress but still no word from what I know. I really appreciate the advice because I have been floating in this boat alone for a bit now.

Hmm. that’s a bit of a weird situation. from my understanding, they aren’t supposed to put a hold on separating or retiring because they can’t make a decision. they should be expediting the process and be sending it off to a higher authority that can decide.
the last thing you should have to worry about is being extended because they won’t let you out, even though they all know medical overrides in this case. that’s what I’m worried about when I get my date. I hope it gets fixed quick so you can just move on with your life.

I would definitely be up anyone’s ass about it until somebody does something and checks on it. So are they saying they are extending you if they haven’t come back with something before your sep date?

I have asked them that question before and they said that they don't know the answer and that it is a possibility. They just keep saying to wait and see what happens. It is really getting annoying honestly hahaha. I have been a squeaky wheel, but I just get the same answers.

It would be ass backwards if they extended be passed my medical separation date just to separate me the same way. I would not put it pass the Navy to do that though.

Yeah, I agree with you there. they do irrational, fucked up shit all the time. I’m hoping for you they just let you out and that they don’t extend, since you’ll get out medically regardless‍♀️

So, PERS wants to null and void my medical discharge that would be happening on 29AUG22 and kick me out under the admin sep. They also want to extend me through November to do so. Most irrational, fucked shit ever. I ask my chain of command, "So, they want to extend me pass my discharge date just to discharge me later?" How does that make any sense? lol

“PERS wants to,” or PERS was directed to do so by the Chief of Naval Personnel, who is the Separation Authority for vaccine refusal cases?

Well, my case is going to the Chief of Naval Personnel but when my command reached out to PERS, they said that is what is most likely going to happen and I will need to be extended.
