Apply for SSDI asa soon as possible, this is great evidence to show that you are not perofrming duties as contracted. Should be able to recieve SSDI.
 
Need to know what result you want in order to tell if this NMA is written "in your favor." Seems to support an unfit finding for your shoulder and PTSD.

Jason I would like to be found unfit for my shoulder and PTSD. I was actually in the process of getting out of the Military and Medical would not let me get out. They told me I needed to be on a Med board instead of getting out.

I have tried to apply for SSDI and they told me I was not eligible for SSDI because they said I was still active duty
 
Whoever told you you could not apply for SSDI while on AD was in error. If you are unable to perform your duties you can apply while still on AD. I applied while on AD and was approved. In fact AD get express handling.

See chaplaincharlie's post- you have been given bad information. You can apply and get approved for SSDI while on active duty.

You wrote that you "tried to apply for SSDI." You should actually apply (this comes up fairly often...a servicemember "tries" to apply for something but doesn't actually apply because someone tells them they are ineligible. Well, never having actually applied means you have not applied AND cannot get the benefit sought). Apply!

When I applied through the social security office they told me that. I argued with them for a while about it but I ultimately lost the battle.

I was going to write a longer separate post on this point- but, I will give the Reader's Digest version here.

I come across this issue all the time. I advise folks to file for something (be it SSDI, INCAP Pay, VA Benefits, CRSC).

It often goes like this:

Me: Looks like you have a claim for (X benefit). I would file.
Servicemember/Vet: Okay...hmm, I am not sure.
Me: File....worst thing that happens, they say no and you have established a date of entitlement.
Servicemember/Vet: Okay, I will.

A month (or six month later)-
Me: What happened with your claim?
Servicemember/Vet: Well, I was told I didn't qualify. My (SSgt/Civilian GS Employee/Commander/1Sgt) told me that I can't apply.
Me: Did you apply?
Servicemember/Vet: No.
Me: Apply.

A month (or six months or whatever) later.

Me: So, I know we talked about this before, did you ever get an answer back on your claim for (X benefit).
Servicemember/Vet: Yes, I filed [or, "No, but I will."].

Tell you what, in the last six months, I have three clients and a handful of people from the forum contact me and tell them that by filing, they were awarded substantial monies. The claims back paid included a range of $80,000 to $155,000. This was all for issues that were outside of any representation that I was engaged in with the client. Just additional benefits that they needed to apply for. (I also have a bunch of folks that I deal with, either as their attorney, or just folks that I have discussed their cases with.....and, for some reason, they refuse or won't "pull the trigger" and actually apply for their due benefits).

Something to chew on....if you don't apply, you won't get a benefit. The battle that is definitely lost is the one that is not fought.

(This is not to suggest that everyone has a meritorious claim- I also deal with this all the time where I believe that there is no claim that will succeed or that a case may be "shaky." However, the same issues apply...if an issue is not pursued and fought out, it will not be granted).

See Jason's posts above. Whoever you were not eligible to apply was absolutely WRONG. You can apply.

The merits of your case will be evaluated and if deemed eligible you will receive compensation. But you must apply to start the process.

You can apply online. Be sure to mark you claim as a wounded warrior (this category includes injured and ill). Best wishes. Mike
 
Good morning,

I am currently on med board, (appeal process formal board date november 5th). I have been on limdu since september 2014. I was put on the med board in January 2015 and my board came back in AUgust 2015 appealed that same week to the formal board. I just applied for Social security Disability. What other benefits can I apply for. Thanks for any answers I will greatly appreciate it.
