I was going to write a longer separate post on this point- but, I will give the Reader's Digest version here.
I come across this issue all the time. I advise folks to file for something (be it SSDI, INCAP Pay, VA Benefits, CRSC).
It often goes like this:
Me: Looks like you have a claim for (X benefit). I would file.
Servicemember/Vet: Okay...hmm, I am not sure.
Me: File....worst thing that happens, they say no and you have established a date of entitlement.
Servicemember/Vet: Okay, I will.
A month (or six month later)-
Me: What happened with your claim?
Servicemember/Vet: Well, I was told I didn't qualify. My (SSgt/Civilian GS Employee/Commander/1Sgt) told me that I can't apply.
Me: Did you apply?
Servicemember/Vet: No.
Me: Apply.
A month (or six months or whatever) later.
Me: So, I know we talked about this before, did you ever get an answer back on your claim for (X benefit).
Servicemember/Vet: Yes, I filed [or, "No, but I will."].
Tell you what, in the last six months, I have three clients and a handful of people from the forum contact me and tell them that by filing, they were awarded substantial monies. The claims back paid included a range of $80,000 to $155,000. This was all for issues that were outside of any representation that I was engaged in with the client. Just additional benefits that they needed to apply for. (I also have a bunch of folks that I deal with, either as their attorney, or just folks that I have discussed their cases with.....and, for some reason, they refuse or won't "pull the trigger" and actually apply for their due benefits).
Something to chew on....if you don't apply, you won't get a benefit. The battle that is definitely lost is the one that is not fought.
(This is not to suggest that everyone has a meritorious claim- I also deal with this all the time where I believe that there is no claim that will succeed or that a case may be "shaky." However, the same issues apply...if an issue is not pursued and fought out, it will not be granted).
