Rating questions

Good morning all, today I found out my ratings, 10% DOD Separation with severance 100% VA. A few questions
1. If I accept severance will I get VA pay? One of the civilians I work with says he accepted severance and the VA took his whole Disability check. My PEBLO says she was told it just takes 10% off of the payment so 3,406 - 340.60? Or would it knock it down to the 90% category?
2. My wife's Tricare benefits, do they go away or is there a way I can pay for them beings I am sep instead of ret?
3. Does my child get kicked from the on base CDC? If so do I get a little longer to find a new school?

Also, I have seen mixed answers on the severance package, I've been in close to four years, is the minimum amount that you times the severance pay by 3 or six years? Again really appreciate any help.

Disability severance pay is a one-time lump sum payment. The amount equals 2 months of basic pay for each year of service which includes active service and inactive duty points, but the total service years cannot exceed 19 years. Additionally, the minimum number of years required for computation purposes is six years for a disability incurred in the line of duty in a combat zone, or 3 years in the case of any other member. Prior to January 28, 2008, a maximum of 12 years and minimum of three years creditable service was used.

Awesome, thank you for the quick reply. Finance is closed today and tomorrow unfortunately. So I think I may get 4 years because I am so close to 4, additionally do you know how accepting the lump sum will affect my VA disability monthly pay? If not perhaps someone I can contact?
 
Ahh never mind, perusing through the Proposed ratings paper and found a few numbers, I'll call them first.

Recoupment.

The VA is required by law to withhold disability compensation payments for service members who received a disability severance payment when they separated from the military (Chapter 61), if the VA disability compensation is for the same disability. This is to prevent a veteran from receiving duplicate benefits.

Exception: The VA will not deduct compensation pay if the military disability severance pay was received for disabilities incurred in line of duty in a combat zone or incurred during performance of duty in combat-related operations as designated by the Department of Defense (DoD)

Lets say I accept severance then the VA wouldn't ever pay for the one the AF paid for. If so it would knock my rating from VA to 90%?
 
What you could do is save that severance pay, and pay off your debt to the VA right away. There for restoring your monthly comp.

You will loose your tri care for your self and family.

As for the CDC if you have a Gov job on base there is a possibility you could still use it.

I am not sure about the nature of your question. The VA provides ratings irrespective of the potential for recoupment of separation pay. The VA ratings remain intact.

Ok, I've been reading the recoupment chapter you stated. Sorry I am having trouble relaying my question correctly. So lets say I do not accept the severance pay and only accept VA if that's possible. My total monthly payment would be $3,406. Great, but now lets say I accepted the severance pay, now my total monthly pay from the VA would be reduced, how much would it be reduced by? Also would it only be reduced until the total amount of severance is recouped?
 
I mean if the total monthly compensation is only reduced by $340 then I cannot complain, but if they take the whole amount then it could potentially be a problem and would warrant me repaying the amount immediately.

from my personal experience with this the VA decides what they are going to take. Its generally $300-$700 a month till the debt is paid off , they generally try to recoup every thing with in a year.
 
Ok so it seems likely that the amount of recoupment pay held from each months disability check is rather large, so now my question is, can I choose to not receive disability severance pay from the AF to prevent any VA pay deductions? If so how? If not how do I pay the debt outright with the lump sum?
 
Oh sorry I didn't see your reply until now, Is there a time that they tell me the deduction amount or do I just get a surprise on my first check?
