For anyone affected by the 8/20/25 interim guidance memo that limited retro CRSC to only the date of submission instead of the date of retirement:

NVLSP and two major law firms have filed a class action lawsuit arguing that this memo directly contradicts the purpose and outcome of the Soto Supreme Court decision. It’s not guaranteed, but there are people fighting this on your behalf.

Because of the memo, thousands lost years of retro. The lawsuit argues the DoD’s new rule violates the law, ignores Congress’s intent, and cuts veterans out of the retro CRSC the Supreme Court already affirmed.

The lawsuit is seeking to restore full retro for everyone affected by the 8/20/25 change- including anyone whose retro was limited to just the month after applying.

So, if you filed on or after 8/20/25, or your decision was issued after that date, this lawsuit is fighting specifically for you. The memo is not the final word - it’s being actively challenged in federal court.

DOD/DOW Interim Guidance dated 20 August 2025 HAS BEEN RESCINDED!

a/o writing this post, I am waiting the official memo and will post it once I can get my hands on it.

Important info regarding retro pay: the services will be amending all approval memos and this WILL take time. Army has processed approx 3,500 claims under the Interim Guidance rules and will be working through ALL claims (to include reconsiderations) going back to 2007, which is well over 15,000 to ensure they're all properly amended. According to my source, Army is down to ONE CRSC Analyst and DOW is NOT allowing them or any other branches to hire anyone to fill their empty slots. You do NOT need to do anything as they will be automatically going through all of the claims. Timeline: huge unknown at this time.

I beg you all to PLEASE BE PATIENT.

No, had nothing to do with that. The VA already set the precedent of retro pay back to the date of filing so it could have easily been argued that way
 
Well huge unknown would be give them a couple months, then you open a congressional inquiry. Just like the Navy’s chicanery with making everyone wait 18 months for their CRSC board decision whilst the Army who I am confident has by far more claims to process due to sheer troop numbers and boots on the ground and AF can process their claims both in about 4 months.

My point is Congress as an equal branch is supposed to provide oversight of federal agencies and hold them accountable as well. Congress cannot do such if they aren’t aware. So their constituents making noise is what makes them aware of some of this. So next time secdef shows up on the capital hill hat in hand asking for $1.5 trillion maybe a congressional rep or two will ask him directly about CRSC delays or maybe send his office or the CSRC board a letter directly.

Most direct way is filing a congressional inquiry on behalf of yourself. That compels the agency to respond to your congressional rep. Done it about 6 times dealing with the VA. They tried to close my appeal, tried to put me at the back of the BVA queue, both times Congress stepped in and said nope.

I don’t know Mike, I wouldn’t dismiss NVLSP, remember they took Soto’s seemingly long shot backpay claim after he fought round and round about PTSD being mortuary affairs and then they tried to short him on backpay. The DOD lawyers probably burned well thru 7 figures tax payer dollars fighting this case over years and years, and whelp they got cooked by NVLSP. The fact the DOD issued that memo was clear they were trying to see what they could away with, some narrow loophole interpretation of the laws and rulings. And NVLSP did sue over this very memo we are discussing…

Anyway I digress.

I don't disagree and know it would have been an ugly fight and drawn out a lot longer than it took to get this decision to rescind. I'm just glad I was 100% wrong in the direction it ended up taking, or you could call it "reverse psychology" at play LOL
