Thanks, Eve1, I knew NVLSP were already in the fight.For anyone affected by the 8/20/25 interim guidance memo that limited retro CRSC to only the date of submission instead of the date of retirement:
NVLSP and two major law firms have filed a class action lawsuit arguing that this memo directly contradicts the purpose and outcome of the Soto Supreme Court decision. It’s not guaranteed, but there are people fighting this on your behalf.
Because of the memo, thousands lost years of retro. The lawsuit argues the DoD’s new rule violates the law, ignores Congress’s intent, and cuts veterans out of the retro CRSC the Supreme Court already affirmed.
The lawsuit is seeking to restore full retro for everyone affected by the 8/20/25 change- including anyone whose retro was limited to just the month after applying.
So, if you filed on or after 8/20/25, or your decision was issued after that date, this lawsuit is fighting specifically for you. The memo is not the final word - it’s being actively challenged in federal court.
