A little late to the party... but here is my current timeline.
The day of posting this is 17 APRIL 2025

OCT 15 2024 - IRILO started
OCT 29 2024 - Commanders Impact Statement signed by commander and member
JAN 3 2025 - notification of dull MEB (FL4 received)
MAR 17 2025 - First VA claim appointment (IDES MEB VA form 21-56EZ filled out)
APR 12 2025 - Last C&P Exam done (VES appointments - 3 total)


Currently awaiting to receive a copy of my DBQ's for my general physical, MH, and Hearing exams




Total Time from IRILO: 184 Days

Total time actually under the full MEB (after receiving FL4): 104 Days and counting...

Is the request for records a FOIA request? I want to requests the docs also so any tips would be appreciated.
I talked to my VA MSC and my PEBLO and they said I shouldn't have to resort to an FOIA and that my DBQ's/exams should be uploaded to either MHS Genesis, or Tricare (X region).
If not I'll work with them to find a way to get a copy, they may just take 2-4 weeks to process. At the very least the exams and DBQ's will be apart of my MEB packet that I'll sign before they get sent up for disability % evaluation.
 
Nice. I went ahead and submitted a FIOA, my MSC isn’t working with me. Neither is my Peblo. The the VA office they were nice enough to print out two of my most important exams on the spot at the least.

Also, as a note; I also received word that those under MEB after the shutdown of Tricare online should not resort to a FOIA request to the VA. Instead the exams 'should' post
to MHS genesis (when ready), OR you can work with your PEBLO to get a copy, OR (according to my PEBLO) you can get a copy when they are included in your "MEB Packet" that you sign before they are sent up for ratings at VERA.







My next C&P exam is 12 MAY 2025, then it is back to waiting :'('

HIPAA requires providers to release a copy of medical information to the patient, so a FOIA is not required.

Thank you sir! Do you know if this copy will be provided via MHS Genesis since the original method; TOL has been shut down? I have been old that this is the assumption but no one has been 100% confirming it. I understand the law says I get a copy, the question is just how?

I'm not involved in this transition and don't have specific informationI think that it is a reasonable assumption that medical records would be handled via MHS Genesis. HIPAA requires specific computer security measures for medical information.
I am not involved in the transition and have no specific information. HIPAA requires medical records be handled only on information systems with specific safeguards; so MHS Genesis would be the easy button.

I was just going through this, trying to ask for copies of my DBQs. Went through base records, genesis, VA, QTC... no go for all of them. Only the VA said they could release it, but only after I've been given ratings. I would also need to provide a FOIA, according to my regional center. This may not be the case for everybody though. You are not alone, I put in for the FOIA.

Requesting your ENTIRE medical record for all of time works, my DBQ's where on there.
Here's the catch: you need to wait and call your eval provider (VES for me) and check to see if the exams are reviewed and submitted to the VA. And then call the VA (you need a VA account) to confirm that the VA has the records are either QA-ing in DC or are processing your claim. As long as the VA says they received your exams, you're chilling.

NOTE: The DBQ's where a WAYS down buried in the record (page 388 - 411 out of 556 pages) so Ctrl + F "VES" (or whoever did your exams) could help, otherwise get ready to scroll.

This is because your DBQ's go to two places (if on active duty):
The VA --because they requested the exam.
And the DOD --because they maintain your ENTIRE health record while you are on active duty.

This is why TOL used to work before April 1st, because unlike MHS Genesis, TOL actually keeps ALL of your medical record, not just certain tests and notes.

MAY 12 2025 -finished 4th C&P exam, awaiting VES to send both the physical exam and 4th exam to the VA. See note below for how I acquired a copy of my DBQ's since Tricare online was shut down.

NOTE:

If you want a copy of your C&P exams, and TOL is shut down; you need to submit a release of records (SF180) to release your ENTIRE medical record for your WHOLE CAREER to yourself (Your personal email).

And then call the VA (you need a VA account) to confirm that the VA has the records are either QA-ing in DC or are processing your claim. As long as the VA says they received your exams, you're chilling. Your DBQ's have been sent to BOTH the VA and the DOD.
