Hi, I was in the army for 5 yrs. as a combo btwn. guard and active, my TDRL was finalized last year and overall feel fortunate that both the army and va did not give me a crappy rating like so many others I know who've been screwed. 70% army and 100% tot. and perm. for va comp.

so am here to see what's what + the main ? on my mind is about VA special comp/aid and attendance. it seems like another hit or miss type prog. to apply to once the hurdles of the med board and va comp have been wrestled w/. didn't hear much about it either and was told quite a few conflicting things about it.

also random curiosity of mine is making me wonder if there are any stats avail. out there w/ a breakdown on the male and female final peb result %ratings...probably not, but am just curious.

well, I wish y'all luck going through this process. my life was a bit in limbo for the duration of it all, but it ended up just fine.

This is a good question, not only if there is a difference in findings based on gender, but other factors as well (rank, time in service, MOS/rating, for officers and NCOs - NCOERs and OERs, etcetera).

Even with the many horror stories I've read on here of the PEB low-balling servicemembers, I tend to think that they still act as an objective body and attempt to be as stoic as possible in their decision-making process.

Though, it would be interesting to get a look at gender, socioeconomic, and other statistics.

so another thing i'm wondering about since i've been scouring for new info. on this is the retirement pay restoration act. it was introduced by sen. harry reid (again) and i can't understand whether it'd apply to ppl w/ less than 20 yrs. of service who didn't qualify for the CRSC pay...if it even passes. anyone know more info. about it?

I have posted on here before but never hit this pat so im giong to now!

My name is scott, Marine with 11 in, Was hurt Aug 27 of 08 doing martail arts training, had aguy do a "can opener" on me, instantly felt ripping in my neck, went to medical on sept 18 08, my pacakge went to the P.E.B. on April 24 08.
It went for, as follows:

722.91 Other and unspecified disc disorder of cervical region
354.2 Lesion of ulnar nerve
338.29 Other chronic pain

I have ROM that is in the dictation, as follows

Extension 10%
Flexion 20%
Left and Right rotation 50%
Side bending 20% to left 25% to the right.
The Doc notes" He clearly as decreased rang of motion in his neck.
Also stated that " the patient incurred this injury while engaged in martial arts training. This is a combat related injury."

My CO stated that I cannot do my job (Motor T) anymore and should be medically discharged. said that I do not have good potential for continued service.That my my performance is not worthy of remaining on active service in a permanent light duty status. That I cannot perform at the level expected of all Marines.

My MRI showed disk herniation at the c6/c7 level with moderate central stenosis and right lateral recess narrowing. Ther is a mass effect on ther cervical spinal cord. There is no high grade compression seen.

I had a EMG nerve conduction studie done, it revealed a borderline bilateral ulnar nerve neuropathy.

I have elected not to have surgery, The surgeon's stated in their dictations that they were not sure if i would benifit from the nuerosurgical procedure, Actaully stated (2 times in my record) that i was reasonable in my decision not to have surgery.

The Doc said that " the patient is a highly motivated hard chargin marine who unfortunately sufferd from cervical disk disease. He has ongoing pain,weakness, numbness and is severely debilitated by these symptoms and cannot remain on active duty with this problem"

Final Diagnoses
1. Cervical Disk Desease
2. Bilateral Ulnar Neoropathy
3. Chronic Pain

Basicaly my neck hurts real bad! mt left arm goes to slepp or hurts all the time. Ipop vicoden and baclofen like candy, helps but not all the way.
Fairly confident that i would have made the Warrent Officer baord this year.
Didnt want to go out this way, however I know that this is the best thing for me, family and the Corps,
I was told that I can " heal myself" by going through a strict rehab plan they are doing in Europe, it will take 5-6 years but will avoid surgery, The docs, both civies and Naval recongnize this direction and believe it will work.
My command has been decent to me as they know that it Im legit in an often crowded group of benie seekers or deployment avioders, Ipushed to get orders to my unit so I could deploy only for this to happen, My unit left for Afgan this week, Really sucked to see them go without me as I do not have faith in the NCO leadership my youngs will have with out me there with them, often makes me feel worthless but then I try to turn my head too far and I am quickly reminded why im not going, Command told me I would be a risk to myself and to my guys wich I would never do.

Well I think that is my and my case in a nut shell, I have found a great amount of Knowledge in this forum and thank u all for it.
I would ask that anybody with a great amount of knowledge (JASON) to read this and give me a general " wathca think" about my case.
I beleive it is pretty cut and dry and have coverd all bases, also I think I have moved thru this pretty quickly, my PCM told me that it is because "it cant be faked and the test's tell the tale". I have my " Home awaiting orders" Letter and endorsement's done as I worl in the Regimental Adj office as a assistant to the Adj.

It looks like your C spine should be rated at 20%. That means you need an additional 10% to get a retirement finding. It seems like all of your additional diagnosis should be "in play" but as you know from reading the other posts, it takes getting documentation as to unfitness to get rated. Seems very likely that they would be unfitting, given the demands of wrench turning. But, the reality may not be reflected in the evidence. That is what you need, good evidence.

I was with the 615th Military Police served 4 years in Germany 1 year in baghdad conducting combat patrols from in the Ghazaliya and Khadamiya districts 06-07.
Thank you Jason for this informative website I wish I saw this when I was going through my PEB.
I was injured in an IED blast which caused several back issues (fractures/disk degeneration and some other fancy words) The VA recently came to a conclusion about my claim and awarded me 10% for my spine stating "it does not cause pain". What I now refer to as my 10% ensures I walk with a cane and/or a back brace. Luckily for me I get to enjoy this 10% for the rest of my life without "pain". [/sarcasm]
oh yeah I got 30% for PTSD aswell

I dont really know much about the appeal proccess other then that I want to. The only thing im worried about in appealing is paying for an independent doc's opinion. Is there anything out there for this? state ran or somthing?

Anyway thanks to Jason and the mods for putting all of this info out there

Edit: I see alot of people request commanders letters I'll try to dig mine up... I wrote it myself my PEB went through so maybe it can help

I will post my timeline when all said and done, I, and most of you will think in crazy, actually would prefer the severance. I own and operate a tree service in the midwest, at 1 time was pretty large, had 2 downscale when I came back in. That 60000+ would help to get it back to where it was and i have coverage thru it. Help the local guys out aswell by puttin some guys back to work.
I cannot be a Marine anymore..........that is fine, I have accepted that, however I will still work for the military as my father-in-law sits on a board that is currently raising money to open a home for vetrans (homeless guys)
they have some senators and congressmen involved for fed grants and have some corp sponsors as well, the have asked me to come aboard and help, I will be honored to do so

I will keep all posted. if any body wants to know what my package has our how i went about things just ask, i will be eager to help.

To me, the PEB is a flawed process, they can do this better, the cases i have read on here are horrible, Jason, I am sure you have seen more. I, when siting with the politicians, will bring this up aswell. U guys deserve to be treated better and moved thru the process faster.

I'm interested in what you and your father-in-law are doing. What part of the mid-west are you located? I fall in the same boat, seperated with severance. I am continuing to try to help disabled service members as I recover. Some just want to move on with their lives and will accept the cards they are dealt, but should be aware of programs out there to assist them. The PEB Forum as I see it has been a great navigational, informational, and personal tool for me. I frequently talk to others inregards to this Forum. Thank you for your continued efforts to help our Nations Hero's.

We are, or we will be soon, in Iowa. Its not my work but the work of my in-laws and a group of people that got together and decided to do this, they have been able to get some real momentum going with it, there are no homeless shelters, or homes in our area, yet we have many homeless vets, this will not be a shelter, but a HOME. They will have docs and nurses lined up to volunteer, retired JAG,s like Jason that are helping, they are buying a local elementary school to turn into the home, that's were I come in, I,m gonna make sure that the place feels like a home for these guys, NOT A HOSPITAL. and oversee the general contractor who rebuilds the place. I could go on for a while!
