National Guard PEB

Hello. I have been Active Duty 6 years and in the Guard one year. My conditions from active duty are worsening due to my Guard duty. I am non deployable, My Dr. has written me a letter recommending MEB. My psychologist is also writing a letter. What do I need the letters to say? I receive 70% VA disability currently.

The Dr. at our clinic said I should've been med boarded out of active duty and recommended me waiving the MEB in the guard to get out quickly. My commander wouldn't sign the paperwork so now I am electing to do the MEB. Now that I want to do the MEB the DR. is saying she can try a PEB but it might not work. What do I do?

Are you Army Guard? As Air Guard is a bit different.

If Army, then find your S-1 MSC. That soldier is typically an E-6 and will handle all your pre-MEB paperwork processing along with state and NGB level coordination.

Is your doctor an Army NG soldier or civilian? Have an NG doc fill out a profile and specially list out each condition on that profile. Looking for P-3 permanent ratings on those items. Guessing you already have a profile since you know you're non-deployable.

Do you have any LODs from your active time? Pull your records to check. There are time restrictions on when LODs must be completed. Mental Health is the exception. LODs are typically what's needed to push a condition into the MEB as service connected. However, any referred condition on the P-3 Profile will be examined. But it must be listed in the pre-MEB phase or risk great difficulty trying to get it added later.

You elect at the beginning of the MEB if you want to be examined for DoD and reexamined for VA or just DoD. If your VA exams are less than 1-year-old, they can be used during the MEB.

Begin building medical packets for each condition.

There's more to it than this but this will get you started.

I am in the Air National Guard. Doctor is Air Force. I have profiles from the Air Force from my injuries. Are you saying have my civilian doctor make a list of my disqualifying injuries? My VA exams are less than a year old.

Gotcha. Air side has a little different process and terminology. There's people on here that maybe will chime in and help out. If not, some basic searches will show similar cases.

You're ahead of the game then if you have the profiles already completed. Make sure those profiled items become "referred" conditions when your medical paperwork is submitted to the MEB.

Do you have any completed LODs? Those are highly beneficial.

And no, I was not suggesting anything on the civilian doc side. Just trying to figure out if you were using civilian or military doctors. Many in the National Guard only have access to civilian doctors. By having direct military doctor access you're ahead of the game there as well.

The IDES MEB/PEB medical exam process is conducted by the VA. Having VA exams less than a year old will help shorten your time frame. Inform your PEBLO and VA MSC of those exams when you get those administrators assigned to you.

I would also put together all your medical packets yourself. Have copies of everything from diagnosis to treatments. Stuff gets lost often even after it's been submitted in front of you. Also maybe add a short personal statement about each condition and how it impacts your life. You can also have a letter from a spouse and or someone close to you. Your commander's letter is very important as well.
