Take Retirement or Try for Fit?

Hello friends,

I'd love some advice on the following:

I was a Navy officer for about 4 years. I had a unique career - I was injured halfway through my first tour as a SWO. MST and conditions subsequent TBI, back injuries etc. My command was not pleased and under investigation for other things so there was some retaliation and I was stashed in a different billet at a different command. I did that job well, but I didn't get a chance to pursue my quals, or continue. By the time the med board finished I was almost at 5 years so an O3. I was found unfit. I tried to fight for fit but did not get it.

In the time since I have attended school and obtained new degrees. I tried to see if I could go back into the reserve JAG, but I received unofficial information from the head reserve JAG saying that the new administration is cutting all reserve JAG (and other professionals billets) so there is no possibility of having any reserve JAG boards or billets. I have my final TDRL determination. The board is offering 30% PDRL.

part of me is torn - take the retirement and go. I did my time and move on and help with veterans in another way.

Part of me thinks - try to fight for fit, get back to the Navy as a SWO, see if I can go reserve SWO, finish my quals if I can and try to transfer later. This is high risk because if the board gives me a medically separation then I lose all the retirement benefits. I am worried as well because if I go back in I have none of my quals and have been out for three years so my lineal group promotions board I would be at a severe disadvantage. And its unknown if I could even make it back into the reserves. Then if I try to go into another branch I'd have a break in service and with my 100% VA rating I would not be able to make it back through MEPS.

Its hard to close the door on the military, I am proud of my career, but its still hard to have it taken away by injury. Any words of wisdom would be helpful or advice if you have tried to go back into the

It would be a near impossible fight to get back in with your ratings. It's a hard thing to work through mentally. You did your job. You got injured serving. It's ok to move on to the next chapter and use those benefits to better your life. Good luck.
