Unfavorable C&P Exam

First time post,

Currently being evaluated for knee issues (undeployable for multiple surgeries starting in 2017).
My PEBLO gave me a copy of my C&P exams and I had read through them to skim for discrepancies, and noticed the one examiner I had imagined I would have had trouble with, did give me a very unfavorable evaluation of my condition.

I have severe laxity in my knee to the point it gives out almost constantly, and I cannot have another arthroscopy and must wait for a full knee replacement. Because of the laxity, I had claimed all the secondary conditions (hip, other knee, ankles, back, depression etc.) and she asked the normal questions on the DBQ, but did not physically evaluate my knee for issues until I vocally asked for it as she was wrapping up the exam. I had read through the exam notes, and no support were given for the secondary conditions, and the only note for laxity in the entire evaluation was that after physical manipulation it's rated the same as a grade 3 tear. I'm processing through my IPEB right now in the IDES timeline and I am worried that her unfavorable evaluation is going to condemn all the problems stemming from the knee injury. I've essentially been performing on active duty with 1 knee for 5 years now, and it's just added up over time. What should I expect from the IPEB and (pending on %) appeal? Just stressing over this as it has been basically an entire enlistment being deemed undeployable.

What did she put as your range of motion? That will determine your disability percentage.

I was recommended to fill a VA Form 21-4138 and identify all discrepancies found and then write a statement about how its wrong and attach medical records. What I did was as follows:

Fill out VA Form 21 4138 and quote the areas the examiner got wrong verbatim listing the section it falls under on the DBQ. Underneath write a statement stating how it was inaccurate.

At the very end write that you have attached pertinent medical information regarding the claim and that you have highlighted areas for reference

Proceed to attach medical records to the document by using PDF merge function into one document including the VA form 21 4138 and highlight pertinent medical info.

Send this consolidated form to your MSC and he or she will put it into your case file.
